Well, it depends on what area of Law you perhaps hope to go into.

But I would choose something that is not on the syllabus or specification of your Law degree at whatever university. So that in the interview you can really impress the interviewers with your showed interest in the different area that isn't featured in the syllabus.

So I would choose something that you are interested in, but make sure the topic is small enough to write that amount on, don't try to answer any big questions!

Good luck!

You're welcome Matthew. It was really beneficial to the unit 4 exam as you quite rightly said, the videos helped put the topic in an understandable and attainable way to allow me to answer a question in the right way. Also on the website, he has made powerpoint presentations which are equally as important with the explanation of case law too.
I am glad someone else was able to benefit from this resource too!

Ah wow good guess on the name! I found the youtube channel just before the Unit 3 exam in January and used it for a majority of Unit 4, it did really help me as well almost like having an extra lesson a week!

I had a look at the website a few minutes ago, I wish I'd found it much earlier the case law slides would have been great to transfer into flashcards. But they're so extensive!

Doing my EPQ on capital punishment and if it should be reintroduced in the UK. Does anyone have any ideas I can work with and/or any other help?

Posted from TSR Mobile

You could do background research about when the UK used capital punishment before and what effects it had then. I would also look into whether or not it would be effective (using academics opinions), and research into countries that use it and what it is used as punishment for.
I strongly suggest finding some decent professional articles on the topic and do lots of reading from them for ideas!
You could also email any university lecturers who have knowledge in the topic area, asking them for their opinion or any free reading material they can recommend for you, since they liked you to use a variety of sources.

I would also include looking at current methods of punishment and assessing how effective they are, and again, you can compare our country's reoffending rate/general crime rates to countries that use capital punishment, and look at possible reasons for the differences (e.g better healthcare, education etc). Might be an idea to compare to America?

You could also look at how capital punishment would be implemented in the UK/how it'd become law. Look at the pros and cons of it...etc etc. There's so much potential!

http://ukpollingreport.co.uk/blog/archives/3802
^ Poll on public opinion on the death penalty.

Are you doing it on Edexcel or AQA? I did Edexcel and my supervisor has given me one mark off full marks (obviously not the final mark, but I doubt I'll go down too much) but if you want any tips in general organisation, for the presentation etc.

One thing I'll recommend straight off is how you do your activity log, make sure it's properly organised and you refer back to your original plan/any alterations/problems and solutions etc. And make sure you do it in enough detail too!
I did a colour coded key (split
my project up into like 8 activities or something, so where it says 'Activity' I put the name of the activity in my log):

Key:
Activity
Reflection on original plan/link to original plan
problems
solutions/responses
next step

Edit: I just read Hello53's post, I really like her idea about religious viewpoints etc! That'd be a good one.

Were all of your results exam based of did you have any coursework components? My 1st semester was all cw based bar one class test which was worth 15% and then 2nd semester all exams. I found that due to the amount of work required I neglected one of my modules which I paid for come exam time and criminal I found there was just SO much! :(

That sounds like a good plan with the prep for next year, what modules do you have at level 2?
For my second year the modules are: land, tort, eu and i chose family law .

, for the contemporaneity rule I firstly talked about mens rea and actus reus of a crime occuring at the same time. I then gave an example of R v Ismail ( throwing of acid in his girlfriends face - he threw acid at the same time as he intended to harm her). Then I said that the principle here is a person can not be guily of an offence for performing an act that causes a previously desired result.
I then brought Fagan into the 2nd paragraph.

Pretty much what I did instead I used Thabo Meli and Fagan I didn't have time to be clever and mention Church so I left it. I felt the entire criminal liability section including the scenario was pretty fair compared to the contract law section-that was pure hell. I ran out of time so I missed question 6 even though it was so easy(it was about mitigating and aggravating factor the court would use) because I simply didnt have time. I feel proud for using another booklet to complete question 18 :$

Hey guys,

I start Year 13 next year and I have a few problems. I only picked three AS Levels at the start of this year; Law, Politics and Philosophy. I struggled with AS Law, due to my memory and the fact that it's awful. But, as I only picked three,I have to continue all of them. BUT, I could drop one and pick up another as. This depends on whether A2 Law is very tricky.

Well, my teacher says we're doing Law of Torts; OCR. Is this hard? Bear in mind my memory is awful and I did struggle with AS. Not greatly, I mean, I understood everything, but when it comes to cases and things it gets hard. Is it worth me dropping it?

Thanks guys,
David

Depends exactly what you found hard at AS. If you did Criminal Law and didn't enjoy it, it's highly unlikely you will enjoy Torts as it's similar to Criminal but a bit less exciting. If you did the legal system, however, you may find Torts interesting.

It's going to get harder, obviously, and there are a lot of cases... maybe try it and see how it goes over the first few weeks?

Spitting on George is application of unlawful force - battery
Waved a bottle of beer could be construed as a threat of force- assault
Both charged under common assault s39

George gripping and throwing- battery
Injury is serve cuts so would come under s20/18 (47 is only minor injury)

I'd say talk about intoxication as well as self-defence. The question has made a point of saying they're drunk, don't ignore the clues! Just b/c it says possible defences doesn't mean they deffo can rely on them. E.g. Ian prob can't rely on intoxication b/c he could form mens rea but the examiner wants to see that you know that.

Good luck :)

Okay, first thing! Duress of necessity doesn't...

Okay, first thing! Duress of necessity doesn't exist in criminal courts only civil. If you meant duress of circumstances and d.o. threats then they will lead to a full acquittal when used for any offence except murder (Howe/Wilson) and attempted murder (Gotts).
And yes, as long as force is reasonable then self defence can be used. Don't forget it's subjective i.e. what the defendant thought was reasonable even if they have got the situation wrong! So if you thought a man was following you at night and was carrying a baseball bat and you launched a pre-emptive strike but it turns out it was an old lady with an umbrella you'd be able to use self defence! (pre-emptive strike is from beckford)

Can i just clarify this, when I was choosing my uni for law I also thought about Birckbeck as i had heard they were targetted by MC firms and silver circle ect also it is a UoL degree with entry req's of AAB and classes in the evening so work at law firms could be done in the day so it looked like a strong choice. However instead of taking word of mouth I emailed Hoganlovells and a few other firms and I got the same response from all of them, that is Birckbeck is not a targeted University but instead they make visits informally. I also presented them with my other choices, being Cardiff, Liverpool, York and Exeter and out of the 5 only Exeter was targeted.
I felt the need to highlight this as people oten confuse what is meant by targeted, I am by no means looking for an argument over this...it is what it is. But I did like the course, the structure, the prestige of UoL on my degree and it took alot to turn away and take Exeter. In conclusion out of what has been presented I believe Birckbeck will be the most helpful in your career, also you are a mature student and will find the class to be of similar standing. Also since it is a UoL college you can use many of the facilities of the other UoL colleges i.e UCL,LSE, QMUL and SOAS this is is because Birckbeck does not really have a large campus or facilities and instead shares them so it will be like you are doing a degree at UCL which is always a bonus

I'm not too sure why they would say that Birkbeck does not have a recruiting relationship with Hogan Lovells. I am not interested in big law but I notice they go so far as to advertise that they have a relationship with Birkbeck. Straight from the horse's mouth as they say..

Well, no. On the implied term theory, the finding of 'void ab initio' is simply the application of a condition precedent. There is, on that view, no room for any external doctrine of mistake -- if there is an offer and acceptance, and no condition precedent is tripped, there is a contract.
The difference between the two is that...

The difference between the two is that subsidiarity is about when the EU can act, whereas proportionality is about how the EU should act once they have the competence to do so.

So with subsidiarity the EU can only act when the measure is better achieved at EU level. This relates to the existence of competence.

Proportionality on the other hand is about what the EU can do with this competence (so how they exercise it). That's when you'd look at the three strand test:
1. Suitability
2. Necessity
3. Least restrictive method

Hope that helps! :) x

Why would Art.3 be breached? Why cant it be derogated? Why is Art.5 enable to be derogated if requirements of Art. 15 are met? Are there any significances for the derogation?

Art. 3 is an absolute right. It cannot be derogation from under any circumstances. Soering v UK established that where a real risk of treatment, which would breach the threshold of Art 3, existed, a State could not extradite a person to those circumstances. Chahal confirmed that principle and extended it to deportation cases - most importantly, irrespective of the victims conduct. In other words, even if a person is a suspected terrorist, they cannot be deported to circumstances which would breach Art 3.

Art 5 has a number of exemptions written into the text. The right is not absolute. Reasons for the difference? There are clearly occasions and circumstances under which a person can be deprived of their liberty. There are never circumstances under which a person can be subjected to torture.

From what I recall, most of the claimants in these unincorporated association types of case (Maga v Birmingham Diocese, Thomas v NUM, etc), just sued all of the trustees, the association itself, and anyone else they could think of because even their lawyers presumably weren't sure who exactly should be liable. But I think the right answer is that the trustees are liable, and insurance against vicarious liability is their responsibility, but they might be entitled to be indemnified out of the trust fund in some situations too?

The only reason they are in a mess is because this line of cases is an attempt to impose an unwarranted liability for the acts of persons who are not servants of any of the defendants.

The nonsense is compounded by the driving of a coach and horses through Catholic canon law in these cases. If vicarious liability is imposed on anyone through superiority, then why isn't a Marks & Spencer floorwalker liable for the torts of the shop assistants under his direction?

If liability is based on ultimate authority then it is nonsense to impose that liability on a group of ecclesiastical trustees or the local bishop or the provincial superior. In Catholic canon law there are only two possible sources of ultimate authority. One is the man who "possesses supreme, full, immediate, and universal ordinary power in the Church, which he is always able to exercise freely" (Canon 331). Unfortunately the Pope possesses sovereign immunity as Head of State of the Vatican City. He of course is himself the Vicar of Christ. The chances of suing God in the Middlesbrough County Court are remote.

In one module handbook it says this for my uni: In order to achieve a pass in this module, a student is required to achieve a minimum overall mark of 40% with no less than 35% in each assessment element weighted 20% or more..

So does this mean that the minimum I can get in the exam is 35% to pass the module?

Yes, assuming that is a general rule that applies to all modules. I doubt you got less than 35% if you only messed up one question. Even on the question you messed up you might have more than 35% as you said you only missed out some of the issues.

There are two trustees so yes, I agree it would overreach the beneficiaries equitable rights.

Therefore, I assume that the proceeds will be held by the trustees on behalf of the beneficiaries but, I am wondering if, under the circumstances, there would be a resulting trust bearing in mind that the purpose of the trust can no longer be attained.

For information, the purpose of the trust is to provide a permanent sport ground for an unincorporated association. You can assume the trust does not fall foul of the beneficiary principle or perpetuity rules.

Many thanks.

The important aspect here is not to confuse...

The important aspect here is not to confuse Denley as a 4th limb in Neville Estates.

Neville Estates [1962] is authority in respect of how gifts are made to unincorporated associations.

Denley [1969] was a case that saved a trust from failure by 'reinterpreting' the trust as a trust for the benefit of individuals.

Therefore, the first thing to do in any question regarding dissolution of unincorporated non-charitable associations where there is a trust involved is to decide if the trust is valid. If so, you can go on to discuss how the property is held using Neville Estates and others as a means to conclude an argument.

Don't forget that a Denley style trust must not offend the beneficiary principle or perpetuity rules specifically, inalienability of capital etc.

I hope I have that right :-)
