</div>I thought it went pretty well. Answered the multiculturalism, ecologism and liberal nationalism 15 markers, and then the feminism 45 marker. Wasn't a fan of the liberal nationalism 15 marker but think I did okay on it - think I absolutely blasted every other question though. But I'm just trying not to get ahead of myself in case I jinx myself or something like that (yeah, I'm a tad superstitious like that).<br />
<br />
That minority rights 15 marker I was hoping to come up as it hadn't come up in ages so I'm glad I revised it - was only really gong to answer a 15 marker multiculturalism question if it was on minority rights or diversity so I was thankful for that. The ecologism 45 marker looked a bit too dodgy for me to undertake even though I told myself I was going to attempt it before I opened the paper.</div>

2 reasons Judges are looking for more human rights (Constitution 10 marker):<br />
- Current uncodified Constitution does not offer sufficient protection of our Human Rights. Even though New Labour introduced the Human Rights Act (1998) it did not sufficiently protect our human rights, and was a disappointing reform for many. <br />
- Judges seek a Bill of Human Rights to entrench our human rights so that they cannot be abused e.g detaining suspected terrorists. <br />
<br />
The sources of the current British Constitution offers both stability and flexibility (Constitution 25 marker):<br />
- Introduction: Explained roles of constitutions and described the British Constitution as uncodified, flexible and unitary.<br />
- Statute Law, the supreme source of the British Constitution offers flexibility as it allows our constitution to remain up-to-date, relevant and modern. Our constitution can move with the times and adapt to changing situations and our multicultural society. Used the 1996 Dunblane Massacre as an example where an Act of Parliament was passed banning firearms. This proves that statute law, the main source of the British constitution provides us with flexibility.<br />
- Conventions and Authoritative Works provide us with stability. Conventions mean that old traditions can be dropped and new ones can be adopted, e.g collective cabinet responsibility. Sometimes in times of struggle and hardship the government must adapt to remain stable, for example the civil unrest during Thatcher's premiership was countered by the ability to lead a more presidential government with her often determining the outcome of cabinet meetings before she even entered the room. Therefore conventions gave room for the government to adapt, providing flexibility and also the power to remain stable. Authoritative works also help the government remain stable as A.V. Dicey's 'An Introduction to the Study of the Law of Constitution (1885)' ensures all citizens have the right to a trial before punishment, and that all citizens also are treat equally and everyone in society is subject to the same justice. This helps maintain stability in our society and government.<br />
- EU Law and Treaties can make our constitution rigid. European Communities Act (1972) which incorporated the Treaty of Rome (1952) meant EU Law took precedence over our own UK Law. Therefore parliamentary sovereignty is undermined and we only have the ability to control UK law, not EU Law which takes precedence and questions the primacy of statute. Although we can pass statute to repeal the European Communities Act, it would be very difficult with many implications.<br />
- Authoritative works have persuasive authority only and can be ignored. They are not the main part of our constitution and are only included as they have been for many centuries. Although this could be dropped therefore preventing destabilizing government. Also, statute law can make and unmake any laws meaning it can create confusion which is not helpful for a stable society. <br />
- Conclusion: Although there are valid arguments for both sides, I believe that the current constitution does offer us both flexibility and stability. Although adopting a codified constitution which would provide us with entrenched provisions which would increase stability, it would hugely decrease flexibility making it extremely rigid. Therefore the question is raised - if something isn't broke, why fix it?<br />
<br />
Reasons for cautious civil servants (Core Executive 10 marker):<br />
- Radical ministers can come in with extreme policies. This can cause caution and apprehension between civil servants, as they have a degree of permanence. This means that as ministers come and go, they become knowledgeable of their department and have a degree of specialism which ministers lack. Therefore they can spot where policy will fail and where ministers are too extreme which can cause caution. This then creates the adversial model in governmental departments which further increases caution. (Only got 1 reason down here, was running out of time and wanted to have enough time to fully complete the essay)<br />
<br />
'The office of the Prime Minister is what the holder chooses and is able to make of it' Discuss (Core Executive 25 Marker): <br />
- Introduction: Discussed how the Prime Minister had various powers and constraints when performing their role and talked about the main jobs of the Prime Minister.<br />
- Power - Patronage: Prime Ministers have power of patronage, giving them free reign to appoint and dismiss cabinet ministers, and select peers by exercising the powers of royal prerogative. Therefore, Prime Ministers have a great power over the selection of his ministers and therefore the Prime Minister's cabinet is completely up to him which means the Prime Minister's office and people surrounding him is completely what he chooses.<br />
- Power - Cabinet: The Prime Minister reserves the right to determine cabinet meeting lengths and frequency, along with the topic and tone of the meeting. For example, Tony Blair's decreased frequency and length, of one lasting just 30 minutes - possibly the shortest ever. Compared to Major's lengthy meetings as he wished to unify his party over the divides caused by the euro. Therefore the Prime Minister can change and adapt his Cabinet Meetings and agenda completely and at his free will depending on how he sees best fit.<br />
- Power - Parliament: The Prime Minister, presuming he/she has achieved a majority government as opposed to a coalition, is able to command the house. He can push through whatever policies he wants. For example, the New Labour landslide victory with a 179 seat majority meant Blair could 'rail-road' policies through, including his devolution and House of Lords reform. Mentioned the House Of Lords Act (1999) and the Constitutional Reform Act (2005). This shows the Prime Minister is free to choose which policies he pleases as long as he commands the majority.<br />
- Constraint - Party: The leader must keep the support of their backbenchers otherwise it will lead to downfall in the party. This can mean that although the leader can choose what policy he wishes, and can three-line whip it if they really want it pushed through, he could lose the support of their backbenchers and lead to disarray in the country. For example, Thatcher loss of power in 1990 after she lost the support of her backbenchers which lead to her leadership challenge from Michael Heseltine. An example of backbenchers causing trouble would be the recent Gay Marriage Bill where Tory backbenchers attempting to introduce various amendments, but were eventually rejected.<br />
- Contraint - Public: To have a long term in office the Prime Minister must retain the faith and support of the public, otherwise they could suffer defeats in by-elections and local elections throughout the term. Then when the next General Election comes up they may not get back into power, so although the Prime Minister can do what they wish during their term in office, they will most likely not be re-elected should they put in any extreme policies. For example, the 2010 Election, where Labour lost as the public had lost faith in Labour's handling of the economy, but clearly the necessary support wasn't there for the Conservatives otherwise they'd have achieved a full majority.<br />
- Conclusion: I agree the Prime Minister can do what he chooses whilst in government and can make of his office what he will, although by putting in too many radical policies it will simply lead to a short term. Therefore, whilst the Prime Minister does have the ability to do what he chooses, it may not be very wise all of the time.<br />
<br />
Overall I thought some questions were rather difficult, timing really let me down for this paper. There was a lot more I wanted to write in all of my questions really, but the time just went so fast. At least it's finished now though :)</div>

			<content:encoded><![CDATA[<div>You REALLY need to know examples for CCEA. I sat my exam today, and they will mark you down if you don't include them. Over the year, keep a notebook of examples eg. examples of backbench rebellions, judicial reviews, etc.<br />
Their spec is really vague so it's a bit confusing to understand. Mark schemes aren't great either. My school rewrote the specification for us.<br />
As for books, Govt. and Politics of NI by Margery McMahon is great for theory. My school gave us this out as a text book. <br />
For the British side I would recommend British Politics in Focus by Roy Bentley, Alan Dobson, David Roberts and Peter Dorey. It's bit outdated which you need to be aware of, but for it really helped me. Also Essentials of UK Politics by Andrew Heywood. This one our school gave us and is more up to date, but was a little vague in parts and didn't include some stuff from the spec.<br />
Unfortunately CCEA don't produce any text or revision books yet.<br />
I'd also advise talking to your teacher and asking for books to look at over the summer.<br />

</u>I talked about the <b>recent reforms the HOL</b> i.e. removal of the hereditary peers etc, as an improvement to its effectiveness (AO2- lack of legal power citing numerous example cba to remember). I then talked about the <b>Demise in the Commons</b> in its ability to check the Government through the partisan nature of PMQs etc and political point scoring. I then went on to mention the shift in scrutiny <b>towards select committees</b>, countering with its lack of legal power etc. I then finished with a final evaluation of the Commons as actually under the coalition with the small majority that the government possesses it is now more effectively checked (citing voting figures) by the opposition rather than the large majorities seen with Blair and &quot;steam rolling&quot; legislation.<br />
<br />
Just wandering what other people put and would this be alright?<br />

Congress can however grant 6 month conditional deployments which are a way around officially declaring war'<br />

			<content:encoded><![CDATA[<div>Firstly we must establish the meaning of &quot;utopian&quot;. If something is utopian, then that is a criticism to state that a particular view or outlook is simply unrealistic and unachievable. <br />
<br />
I'm guessing this was a 45 marker and if so they wanted a variety of points to explain how anarchism is utopian and others arguing how it is not. I'll list out a few various ideas:<br />
<br />
- Conservatives who hold a very pessimistic view of human nature would argue that a society without a state would never work. Due to individuals being egoistical and self interested, they will always aim to further enhance their own interests. Thus power is always going to be a natural characteristic which individuals strive to acquire. Hence to say society will happily operate without a sense of authority is merely a utopian creed. <br />
- Additionally, many liberals would agree with conservatives that due to individuals being self in<br />
terested, a state is essential to place restrictions into place to prevent individuals from infringing on the freedom of others through acting on other regarding actions which are unjust as John Stuart Mill stated. Conservatives and Liberals would therefore agree that a state is a &quot;necessary evil&quot; as expressed by Thomas Jefferson and Thomas Paine, albeit to differing extents. <br />
<br />
- Marxist would argue that despite human nature is sociable and wishes to live in social harmony and social solidarity among one another, a state is still an essential institution required in order for the ideal society to be reached. The likes of Karl Marx would agree with Mikhail Bakunin that there is a bourgeoisie state which only acts to further enhance the interests of the bourgeoisie in society. However, anarchists would argue that the state must be taken down at once for it is a coercive and compulsory body and power corrupts absolutely thus it must be abolished. Communists would argue that this is utopian for in order for communism to be successful and for society to operate under common ownership and collectivisation, the state is essential as acting as the dictatorship of the proletariat; a working class state which can prevent counter revolution of the bourgeoisie and ensure the transition to communism is successful.<br />
<br />
- I'm not sure how you would argue much against it being a realistic  creed though. Maybe, you could push forward with Murray Rothbard's idea  of anarcho-capitalism and use that to explain that with the ever  advancing rise of capitalism throughout the world, it is seen a more  acceptable idea to believe that society could operate around a purely  free market of laissez faire economics, where market fundamentalism  would be at the heart of society.<br />
<br />
- You can then look at previous history and explain how anarchism has arguably not been very successful and has gained a bad reputation. Anarcho-syndicalists such as Georges Sorel and has violent ideas have potentially resulted in anarchism been seen as a barbaric movement which cannot be taken seriously in contention with other ideologies such as Liberalism, Conservatism and Socialism. In recent years, acts such as the London Riots have been referred to as anarchic acts which simply go to show how human nature can be violent and dangerous, hence to live in a society with absence of a state is seen by most as a ludicrous proposal. Hence you can come to a logical conclusion that anarchism is a utopian creed</div>

I'm taking the A2 OCR Contemporary US Government &amp; Politics next week. Anyone else?<br />

I was wondering relevant/up-to-date examples they'd expect us to know. I'm having a bit of a panic that I don't know them in enough detail! I.e. it's not easy to find out various votes etc from committees on immigration legislation or anything.<br />
<br />
Any tips on where to find out relevant concise but detailed examples? I've already done the obvious Washington Post, New York Times, <a rel="nofollow" href="http://www.opencongress.org" target="_blank">http://www.opencongress.org</a> and stuff. But there's LOTS of information but not all of it relevant and/or goes into too much detail?<br />

I started a list of things/events I think they'd expect us to include in answers, if possible:<br />

</div>To get reasonably high marks for the essay you must have evaluated the strengths of the UK constitution. Giving the strengths is not enough, you have to give the arguments against within the same paragraph, or if not, in separate paragraphs at the least.</div>

I don't think FOI was involved in that.  FOI is less about the judiciary doing things than about private individuals or bodies doing things.  For example, I ask the Cabinet Office for statistics about staff transfers, or a school about policies.</div>

I did the same question. The question basically means do people vote long term or short term.<br />
<br />
Volatile - Declining levels of class alignment (Labour voting Tory and Tories voting Labour etc)<br />
            - Declining levels of party ID (more floating voters)<br />
            - More influenced by short term factors e.g. Many labour voters went to Lib Dems in protest of the Iraq war in the same way Conservatives lost voters after 'Black Wednesday' <br />
<br />
Stable - Still racial link between the parties e.g. 60% of non-white citizens voted Labourt <br />
           - Still geographical link e.g. Conservative dominate the south whilst Labour dominate the North and Wales and Scotland<br />
           - Still an age link - older people vote Conservative<br />
           - Still evidence of class alignment e.g. in 2001 - Conservative gained 40% of the class AB vote (still a huge slice)<br />
<br />
In conclusion I said: despite influential stable factors such as geographical location and ethnicity, it is clear that partisan and class de-alignment suggests that the modern British electorate are becoming more volatile and rational short term issues usually prevail over long term stable links. This is demonstrated through the rise of floating voters in modern Britain.<br />

</div>I believe it is because the European Court of Human Rights has ruled that Abu Qatada cannot be deported as he will be tortured. I would presume that although the HRA is not binding on Parliament due to parliamentary sovereignty, however while ECHR law isn't technically &quot;binding&quot; when the Court makes a decision we are bound by convention to follow it. Since the issue at hand is torture (and not, votes for prisoners, for example), its decisions are more important and not following them would make the UK look bad. The document I attached said this:<br />

<b>6.4 Can Abu Qatada be deported despite the ruling of the European Court of Human Rights?</b><br />

It has been suggested by some critics of the current judgment that it is possible to ignore the decision of the European Court of Human Rights and deport Abu Qatada91, since the UK’s highest domestic court had previously ruled in favour of deportation. Former Security Minister, Baroness Neville Jones, has been reported as having said that the Government shouldn’t rule out such an approach in the “long term” if current negotiations were not successful.92<br />

This would not be legal under international law (founded on the UK's treaty obligations). Most legal experts confirm that while the UK remains a member of the Council of Europe and a State Party to the European Convention on Human Rights, it must fulfil the human rights obligations stemming from Court judgments. A short article by Douglas Murray in the Spectator notes the actions of the Italian Government in the case of Essid Sami Ben Khemais (who was deported to Tunisia despite an interim measures ruling by the European Court of Human Rights that he remain in Italy). The Strasbourg court ruled that the Italian Government had breached Articles 3 and 39 of the European Convention on Human Rights by deporting Khemais. It awarded the applicant 10,000 Euros in respect of non-pecuniary damage and 5,000 Euros for costs and expenses under Article 41 of the Convention.93</div>
