I don't think it really matters - only 850 or so people live in the Vatican, of which around 45 are regular people - the rest are clergy (who can't have sex) or Swiss Guards. It's still kind of random though - it's probably a law from over a hundred years ago and hasn't been changed, I dunno.

The Vatican effectively adopted the Italian Penal Code of 1929 wholesale when the state was created.

However, I think this fact is wrong. Until 2008, the Vatican's criminal laws automatically kept pace with Italian criminal law. As they were updated so too, I believe, were the Vatican's. So until I see a decent source for this, I won't believe it.
