Marriage, legal status and rights

I have two questions.

I was discussing the institution of marriage with my boyfriend and he says marriage nowadays is a legal status which gives you rights as a couple (eg the next of kin thing) while I thought it was more an official promise to stay together forever. I understand it often isn't used like that since the divorce rate is so high, but I was wondering how it was viewed in general ESPECIALLY in the eyes of the law. Is it really hard to undo? Lawyers?

A second question (probably more for lawyers again) which is related is a question about what rights we'd have as a cohabiting couple eg if one of us was in hospital would we be allowed to find out about them, or would it have to be next of kin?
