In exams, how much are we to go into detail on CPR 54

Hi all,

My question is as per above, with regards to problem questions. For example the question is

Advise Michael. Your advice should include possible grounds of challenge, the procedure under Part 54 CPR and possible remedies;

My gut feel in describing the procedure for CPR is:
1. Step 1: Has ADR required by Pre-action protocol been exhausted.
2. Step 2: Is this injunction or declaration alone? If so, use writ/summons, or rely on JR subject to courts' discretion.
3. Step 3: Is this injunction/declaration combined with prerogative remedies? If so, must use Jud Review Procedure.
4. Step 4: Time limit of filing claim? Is it do-able within 3 months?

Beyond this, i am not sure. Do we need to explain the permission stage and the hearing stage? Doesn't sound very relevant to me, and takes up a lot of time too, especially under exam conditions.

Senior forummers, pls shed some light! :tongue:
