    Sex Bill 2011

    An Act to legalise and license brothels, to repeal the anarchism that states male homosexual sex, to allow kerb-crawling and to equalise the ages for having sex and viewing videos of sex.

    BE IT ENACTED by The Queen's most Excellent Majesty, by and with the advice and consent of the Commons in this present Parliament assembled, in accordance with the provisions of the Parliament Acts 1911 and 1949, and by the authority of the same, as follows:-

    Part I: Brothels
    1 Legalisation of Brothels
    (1) Sections 22-31 of the Sexual Offences Act 1956 are hereby repealed.
    (2) Sections 33-36 of the Sexual Offences Act 1956 are hereby repealed.
    (3) Sections 41-42 of the Sexual Offences Act 1956 are hereby repealed.
    (4) Sections 52-56 of the Sexual Offences Act 2003 are hereby repealed.
    (5) A licensed brothel shall not be considered a public place for the purposes of the Sexual Offences Act 1956.

    2 Licensing of Brothels
    (1) Brothels may be placed in any building designated, by issuance of a licence for that purpose from the local authority licensing board, on petition from a prospective licencee.
    (2) Licences shall be renewed annually.
    (3) The local authority licensing board may reject an application made under section 2(1) of this Act on any of the following grounds:
    (a) It shall, or is likely to, present a disturbance to local residents.
    (b) It is deemed contrary to public morals.
    (c) The prospective licencee is deemed improper to run a brothel.
    (4) The licencee must be in possession of the building, by lease or ownership.
    (5) Licences are non-transferrable, between persons or buildings.
    (6) The licencee shall be responsible for ensuring that all persons engaging in prostitution within the establishment are free of any sexually transmittable diseases.
    (7) A licencee must take reasonable measures to uphold their responsibilities under section 2(6), it shall be an offence of reckless endangerment not to. These reasonable measures include:
    (a) All acting prostitutes have been examined by a physician within the past month, and have written documentation are free from sexually transmitted diseases.
    (b) All clients have been examined by a physician within the past fourteen days, and have written documentation to show that they are free from sexually transmitted diseases.

    Part II: Sexual Miscellanea
    3 Prevention of Human Trafficking
    (1) In order to be a prostitute in a brothel, one must have a prostitution licence.
    (2) A prostitution licence shall be valid for 3 years from the date of administration.
    (3) A prostitution licence shall be administered after an anonymous interview to determine whether the prostitute is fully consenting in the decision to become a prostitute.
    (4) In the case that an interviewee testifies that she was coerced into this, the interviewee may be offered, and can request, protection under the witness protection programme.
    (5) Where necessary, the information from the interview shall be passed onto the relevant Police authority.
    (6) Where police find brothels with unlicensed prostitutes, they shall investigate the brothel, and shall have the power to revoke the brothel licence.

    4 Liability of Parenthood
    (1) In the case that an act of conception involved a monetary transaction, the prostitute may not claim child support payments from the client, subject to the exception in sub-section (2).
    (2) Child support payments may be claimed in the case that the prostitute took reasonable precaution to avoid pregnancy, and that they were coerced into becoming pregnant.
    (3) In the cases described in sub-section (2), County Courts shall arbitrate where a voluntary settlement cannot be reached.

    5 STD Examinations
    (1) Examinations as specified in section 2(6) may be administered by all physicians and sexual health clinics.

    6 Buggery
    (1) Section 12(1B)(a) of the Sexual Offences Act 1956 is hereby repealed.

    7 Pornography
    (1) The age at which one may purchase pornography shall be 16.
    (2) Any change to the age of consent for sexual intercourse shall change the age of purchase for pornography, such that they retain parity.

    Part III: Miscellaneous
    8 Short Title
    (1) This Act may be cited as the Sex Act 2011.

    NotesSections 33-36 of the Sexual Offences Act 1956 are those relating to the offence of keeping a brothel, while sections 22-31 are offences relating to the running of a brothel, such as a man living on earning of prostitution - or to the client, with procurement of prostitution. Sections 41 and 42 relate to punishment of offences connecting with running a brothel - so they can go too, since it's no longer an offence. The bits of the 2003 Act repeal make it an offence to 'causing someone to become a prostitute for their own gain' which would not enable employment of prostitutes in profit-making brothels, hence the repeal.

    The 1985 Sexual Offences Act makes in at offence to solicit prostitutes on the street - and we consider sexual acts between consenting adults to be no business of the state.

    Sections 2(1)(b) on this Bill is to give authority boards to grounds to reject brothels next to school buildings, for example. 2(1)(c) is to allow the applications from those with sexual convictions to be rejected.

    Changes for the second reading? Minor. Kerb Crawling section is gone, and so is the section saying that examinations with certification won't be funded under the NHS - anyone can get a free STI test currently anyway - and writing a document costs no extra, so it's a bit irrelevant.

    Changes or the third reading? The new sections 3&4, the rest is identical.

    How would you find this out?..Surely both parties would be completely biased?

    Read onto section 4(3) - it sets out the arbitration process.
