hi, got my contract exam next week and i cant choose out of the following 2 questions...any suggestions or general ideas would be helpful!

1. 'no consideration, no contract'. this can no longer be described as the approach to contract variation. instead, the modern law concentrates on what si the real question; whether both parties genuinely consented to the variation.

do you agree? illustrate your answer with examples

2. 'in contracts, you do not look itno the actual intent in a man's mind. you look at what he said and did. a contract is formed when there is, to all outward appearences, a contract'

is this a true refelection of the concept of agreement? give illustrations for your answer
