    ESA, DLA for disabled student (Medical Examination)
    Hi all,


    I have really benefite so much from this site and I am really in need now to know a very important information. As I am starting uni and and gave up my job I decided to apply foe ESA as many said I might entitled to it. I applied and they sent me a form which I filled in and sent back. They sent me a letter asking me to attend a medical examination which I did and it was awaful the guy there thought I was making things up and I am never in pain he also ignored all the medical evidence that i gave him. What I am worried about is if the ESA medical exam failed would that stop my DLA as well and if the DLA stops that means my whole university life is ruined as I rely on my car to go to uni, i use the allowance towards washing and of course if there is no DLA then there is no DSA I have not slept proparly for the last two due to these issues and problems
    Please help
    would the DLA stop if they said I failed the ESA medical
    would they stop it immediatly although i have it for indefinte and i get a car eon mobility?

    ESA is the replacement for incapacity benefit.
    The assessment you have just had whilst not by itself capable of stopping DLA, may result in you now being called in for a reassessment of DLA, as everyone will be in the next 4 years. Whether you had it indefinitely or not is going to be reassessed.

    I know that everyone has to go through reassessment for DLA but I am worried that people are talking about the DLA being stopped as the DWP will use the ESA medical examination have you come across someone who experienced that?

    No and that isn't going to happen. They use completely different criteria.

    You may still keep your entitlement to DSA, even if your DLA payments cease.

    But, no, your DLA will not automatically cease.

    At worse you will be re-assessed (which, as already mentioned, everyone will face medical assessments in the coming years) but your DLA certainly won't stop because it's been decided you're not entitled to ESA - they are two different benefits with different assessment criteria.

    Hi all,


    I have just received a phone call from ESA assessor and she said to me that because I am receiving a grant that they will not be able to pay me ESA entitlement I thought the grants are not part of the calculation can someone help me and direct me into the right direction please does any know where in law it says grants can be taken into account?

    Income-related ESA is part of the calculation. Contribution based ESA is not.

    As far as I know anyway.

    thanks RA3 I think you misunderstood me I am talking about when they decide whether or not I am entitled to ESA should they or should they not take grants from SFE into account? as far as I know they do not

    Are you receiving the Special Support Grant?

    I am receiving the special support grant yes and also the adult dependent grant with student loan

    As far as I'm aware then, no, it isn't taken into account with income-based benefits (this includes Housing Benefit, and you might know this already, you may be entitled to). Experience tells me that probably don't know what they are doing, unless there's something else to the story. You'll just have to contact them and ask if you haven't already done so.

    ESA does take into account the grant and loan as income. I argued the toss that I have to repay the loan and that it should be assessed purely on the grant, unfOrtunardly that's not the case.

    Good luck is all I say. I had a terrible ordeal claiming ESA which consisted of 4 medicals and untold amount of bullying. The medical staff were at a Loss and couldn't ynderstand why I was being repeatedly examined. The whole process gave me a relapse.

    Hi all,


    Thank you so much for the help and I am really in need of some more advice. few days ago I received a letter fromt he DWP saying that they coming to visit mew at home a woman is coming to discuss my claim for ESA my claim was rejected and it is at the appeal stage at the moment. i am really worried and anxious as i receive DLA as well and this might be for home examination for DLA has anyone experienced that before or received a letter from the DWP saying they coming to visit them it is not the customer compliance officer coming to visit me it only says we are coming to discuss your claim for ESA

    If it says the visit is about ESA then that is all it will be this time. As has already been explained ESA and DLA have completely different criteria.

    Hi all,


    After a long long wait the ESA tribunal had replied to me and said that they cannot decide the appeal until I gave them consent to access my medical record. They want me to sogn the authorisation for them. Can someone help please and tell me if they had this request before? should i do it or not ?
