    I did, yeah I agree.. I didn't know if it was worth mentioning all of the special and general damages, because some of them only apply if the claiment has experienced an injury.. I ran out of time too! So annoying

    What did everyone write for the question about the brain damage part (forgot what the actual question was now) but it was the question after the criminal liability one?

    I wrote about the chain of causation being broken due to negligent medical treatment I think.

    ^ I did the same, and referred to Jordan as the medical treatment being palpably wrong.

    I also put occasioning actual bodily harm, as he felt sick,law teacher sed it would be correct, everything in the scenario is there for a reason.you must pick out all the detail, I was resitting it btw. I used my law03 application

    Thought i'd give this a bump, what a crock of **** this exam was, I got lower despite knowing the material inside out. Still fail to see the point of removing a question just to redistribute the marks elsewhere.

    Fergo. I know what you mean. Something was wrong with the marking on it. My class had 19 Us down from 17 As in June for the same teacher and syllabus. My college is sending the papers back for a remark. Did anyone else see a similar result? For A2 it was business as usual.

    Went from a C to an A. I am ridiculously shocked considering the change in marks for the questions, but sooo happy. Barely any of us resat though so I'm not sure what went on with mine.

    That's okay it's just i got my individual marks back for each question and i managed to get an A but got 0/10 marks on 3rd to last on tort so i wondered what it was. Nevermind though

    My teacher had them just on a spreadsheet and showed us what we got for each question/topic just to see which we did better on.

    Hey, I found the paper

    The questions for tort were:

    08) Explain how the law decides whether a duty of care is owed in negligence (7 marks)

    09) Breach of duty requires the claimant to prove that the defendant has fallen below the standard of care of the reasonable man. That standard is assessed by taking into account one or more of the risk factors. Briefly explain three risk factors (7 marks)

    10) Briefly explain the principle of res iqsa loquitur and how it applies in negligence cases (5 marks)

    11) Discuss whether Robyn owed a duty of care to Elsie (7 marks + 2 marks for A03)

    12) Assuming that Robyn owed a duty of care to Elsie, discuss whether she was in breach of that duty (7 marks)

    13) Outline the three-track case management system used in the civil courts and briefly explain which track is most likely to be used in any claim that Elsie could make against Robyn (5 Marks)

    14) Assuming that Robyn were found liable in negligence, explain how the court would calculate an award of damages to Elsie. (7 Marks)

    Resitting it for a third time after getting a d (?!) in Jan.

    Sigh :/

    Hey everyone-did you need to know procedure to trial for either-way and indictable offence for this exam? It seems like the summary offence question ONLY comes up and either-way and indictable is unprecedented.

    These questions are from the may 2011 exam, not the january 2012 exam?? I'm wanting to know the question from the tort section of the january 2012 exam??
