Breivik Trial: Judge calls for death

    Breivik Trial: Judge calls for death

    One of the judges on the 5 man panel overseeing Breivik's trail has been thrown off the case after calling for the death penalty on Facebook just after the mass killings took place. Was this unfair on the judge as emotions were running high and the comments were made outside a professional context?

    Certainly unprofessional, and he should have to just waited to sentence him to death which he might have had a chance at doing.

    Judges are not supposed to let their own emotions interfere with the trial. If he felt so strongly about the case that he posted death to breivik before he knew all the full details then he should definitely be thrown off the trial

    Hmm, sticky situation. A mistake on the judge's part in my opinion, since Breivik had already been seized.

    Though I'm sure the judge is only highlighting an opinion carried by probably at least 1 other judge and several of whichever jury oversees this.

    Although his feelings are completely understandable and probably shared by many, it was unprofessional of him to post that, particularly if he was a judge at the time because he must have had some idea that he might be called upon as a lay judge. He shouldn't be on the panel, but only because it'll give Breivik's defence some ammunition, and he doesn't deserve anything that could help him get away with anything less than the maximum possible custodial sentence.

    I say he should be locked away in a cell till he dies. He deserves to suffer, his crimes are monstrous.

    Death has no suffering.

    very very unprofessional to say the least. The trail has barely started yet. But i dont see any surprises coming. He is a sick individual to say the least.

    Agreed with everyone on this thread. It was unprofessional - the judge shouldn't have been expressing his own personal inclinations about the case during the course of the trial. It's also indicative of a judge who has made up his mind about the case before everything has been argued before him, which is unfair.

    Norway doesn't have the death penalty. All he can get is life in prison.

    To be honest, I didn't even read the article/know what this about - I do know, however, that a judge shouldn't be so vocal about such a thing especially out of court.

    It was a "lay judge", not a member of the judiciary. They probably weren't aware they'd be involved in the prosecution when they posted something on facebook, so it's not so outrageous. Though that isn't to say that they should remain involved in the case having advocated punishments which aren't legal in Norway.

    You're letting your emotions get in the way of clear thinking. What functional, practical purpose does making him suffer serve? It won't bring back the dead, and it won't help to repair the situation in any way at all. All that matters is that he's off the streets and isn't going to try anything like this again.

    He's not about punishment of the judge... It's so there's less chance of the verdict being overturned later due to the judges being prejudiced against the defendant...
    It's not just about getting the 'right' verdict... The process of getting there has got to be seen to be spotlessly fair to the defendant. There doesn't seem much doubt that the evidence is overwhelming anyway, they don't want a prejudiced judge screwing a clear cut case imo.

    All that the poster you were quoting was hoping for was for him to be in jail for the rest of his life - that's hardly letting emotions getting in the way, I think it's what every sane person who has been following this story wants, because it's what Breivik deserves.

    Definitely not unfair, that person had no place overseeing the trial. You cannot judge what you have pre-judged.

    I agree with the insightful user saying it's to prevent an unfair verdict that may release Breivik.

    It's difficult for anyone not to have an opinion on mass murder, it's just this person spoke out.

    Sham trial is a SHAM! We KNOW he did it so he should just be strung to a post and filled with 9" bullets right away. Why waste 10 weeks, the worlds attentions and dawkins knows how much resources on this waste of time trial?! He was even FILMED shooting his victims :lolwut: Mind boggling. He wanted his 15 minutes + of infamy and these idiots are giving it to him. At least the Yanks wasted Bin Laden and quietly threw him in the Atlantic.

    The judge should of remained on the panel. I can't see what he did wrong. If this was a normal case, I would agree with his dismissal otherwise.
