    B445 - Male Child Genital Mutilation Bill 2012, TSR Libertarian Party


    Male Child Genital Mutilation Act 2012

    An Act to amend the law relating to the circumcision of male children.

    BE IT ENACTED by The Queen's most Excellent Majesty, by and with the advice and consent of the Commons in this present Parliament assembled, in accordance with the provisions of the Parliament Acts 1911 and 1949, and by the authority of the same, as follows:

    Part I: Offences
    1 Offence of male child genital mutilation
    (1) A person is guilty of an offence if he partly or fully removes a boy's foreskin, or in any other way mutilates a boy's genitalia.
    (2) But no offence is committed by an approved person who performs a surgical operation on a boy which is necessary for his physical or mental health.
    (3) There is also no offence committed by a person who—
    (a) performs a surgical operation falling within subsection 2 outside the United Kingdom, and
    (b) in relation to such an operation exercises functions corresponding to those of an approved person.
    (4) For the purpose of determining whether an operation is necessary for the mental health of a boy it is immaterial whether he or any other person believes that the operation is required as a matter of custom or ritual.

    2 Offence of assisting a boy to mutilate his own genitalia
    (1) A person is guilty of an offence if he aids, abets, counsels or procures a boy to excise, infibulate or otherwise mutilate the whole or any part of his own genitalia.

    3 Offence of assisting a non-UK person to mutilate overseas a boy’s genitalia
    (1) A person is guilty of an offence if he aids, abets, counsels or procures a person who is not a United Kingdom national or permanent United Kingdom resident to do a relevant act of male child genital mutilation outside the United Kingdom.
    (2) An act is a relevant act of male child genital mutilation if—
    (a) it is done in relation to a United Kingdom national or permanent United Kingdom resident, and
    (b) it would, if done by such a person, constitute an offence under section 1.
    (3) But no offence is committed if the relevant act of male child genital mutilation—
    (a) is a surgical operation falling within section 1(2), and
    (b) is performed by a person who, in relation to such an operation, is an approved person or exercises functions corresponding to those of an approved person.

    Part II: Penalties and Extent
    4 Extension of sections 1 to 3 to extra-territorial acts
    (1) Sections 1 to 3 extend to any act done outside the United Kingdom by a United Kingdom national or permanent United Kingdom resident.
    (2) If an offence under this Act is committed outside the United Kingdom—
    (a) proceedings may be taken, and
    (b) the offence may for incidental purposes be treated as having been committed, in any place in the United Kingdom.


    5 Penalties for offences
    (1) A person guilty of an offence under this Act is liable—
    (a) on conviction on indictment, to imprisonment for a term not exceeding 14 years or a fine (or both),
    (b) on summary conviction, to imprisonment for a term not exceeding six months or a fine not exceeding the statutory maximum (or both).


    6 Definitions
    (1) Boy means any male person who has not attained the age of sixteen.
    (2) A United Kingdom national is an individual who is—
    (a) a British citizen, a British overseas territories citizen, a British National (Overseas) or a British Overseas citizen,
    (b) a person who under the British Nationality Act 1981 (c. 61) is a British subject, or
    (c) a British protected person within the meaning of that Act.
    (3) A permanent United Kingdom resident is an individual who is settled in the United Kingdom (within the meaning of the Immigration Act 1971 (c. 77)).
    (4) "Approved person" means a registered medical practitioner.
    (5) This section has effect for the purposes of this Act.

    7 Consequential provision
    (1) In paragraph 1(b) of the Schedule to the Visiting Forces Act 1952 (c. 67) (offences against the person in respect of which a member of a visiting force may in certain circumstances not be tried by a United Kingdom court), insert—
    xiii - the Male Child Genital Mutilation Act 2012

    Part III: Miscellaneous
    8 Short title
    (1) This Act may be cited as the Male Child Genital Mutilation Act 2012.

    May I suggest the amendment of "(1) Boy means any male person who has not attained the age of sixteen.", to become "(1) Boy means any male person who has not attained the age of eighteen."

    Aye. It's one of those things that, if an alien popped by, they'd rightly ask "wtf do you do that for?" Religion should generally stay away from people's genitals unless voluntarily admitted by the owner once they themselves are a free-thinking adult.

    My circumcision was the best thing to ever happen to me, I don't remember any of the supposed pain I should of had and it has not caused me (or anyone else I know) any mental scarring.

    It is a rather backward barbaric act and people that want it done can do it aged 16 everyone's a winner.

    Why would I joke about my circumcision? it really has been the best thing that has happened to me... and the ladies prefer it

    Just because you like it doesn't mean everybody likes it, and it's wrong to do this to someone when they don't have a choice.

    Then why didnt you do it when you were old enough to make your own decision...and in reply to your previous post just because you dont remember the pain doesnt mean we should discount it if it did occur.

    I don't know how anyone can be against someone's right to not have their genitals mutilated.

    Agreed. Circumcised penises are preferable aesthetically, not to mention more hygienic. It isn't mutilation since it actually confers a benefit, unlike female genital mutilation which is performed strictly for the purpose of making sex more painful for women. What a silly idea for a bill, this decision is better left up to parents.

    Religious freedom 'says' no such thing. Religious freedom means you are free to believe in and practice whatever you want to, this does not mean you can push your beliefs on another person who has, as yet, had no choice on the matter. Whether or not women prefer to look at circumcised penises is really not the point: if someone wants it done that badly, they can get it done whenever they like once they reach the age of consent.

    We're not discussing the merits of circumcision here: only whether or not it can be forcibly done on people who have no given consent, namely babies. You can take your bald-bellend pride elsewhere.

    As I understand this Bill it will stop a long standing tradition of the Jewish people which I feel is totally unfair considering there is no public outcry from people who were circumcised as a baby then grew up resenting their parents for it..

    Therefore I am against this Bill.
