"Small claim online" user experience advice ? (Civil dispute)

    hi !

    any tips or user experience advice on it from anybody here ?

    a Law students welcome here to comment, + anybody with knowlidge or and experience.



    I have a problem with a MC Parts seller in UK (private seller, hence Civil case) who has stolen my money and parts. I have been building evidence, everything recorded. UK police is not able to help me as its Civil case as mentioned.


    i tryed "Advanced Search" on this forum but didnt yet find simular topics. if they exist, please point them out.

    I haven't used it personally, but I can confirm its perfectly legitimate and straightforward to do. Its just an online part of Northampton's bulk processing centre. Just fill in the information as best you can and pay the issue fee (which you will get back if you win the case) and then wait to hear from them.

    Most small claims won't be defended, but don't worry if it is, just make sure you have enough evidence to prove your case. I would advise putting together a short "witness statement" (a few pages, most) of what happened in chronological order, as though you were explaining to someone who has no idea what has happened. Also keep hold of any documents or correspondence from your opponent, and include a copy of these documents on you Money Claim Online form, assuming it gives you the option to do so.

    Your local Citizen's Advice Bureau, or better, Legal Advice Centre will be able to help you with this too

    (FYI I've volunteered at both; I'm not just making sh** up :P)

    thanks for your both replyes.

    that link was helpfull in deeper details. ive been reading it carefully.

    i have a planned and prepped visit into Citizen's Advice Bureau. ive been building a case evidence for a 1,5 years now, as the person who took my money and stolen all ,hasnt replyed back to me in any way or form in several several months. i have hoped and given him so many opportunitys to to solve all now, without even asking any Compensation for lost time etc, and to make clear i havent said a single nasty word to him or said-made any form of threat.

    i have a very good evidence including 3rd party wittness who is the Opponents family member. + i have found and interwieved also others who have been harmed scammed by this same person.


    Something i want to ask you both, its little confusing to me :

    "Just fill in the information as best you can and pay the issue fee (which you will get back if you win the case) and then wait to hear from them."

    at the link i posted on message #1 is stated 120£ + VAT per hour.

    what you said "Wohamanah" sounds like no win no fee service.. ? what am i getting wrong now ?


    Seems that my Claim would be Online form made, as it seems that i would not be getting legal fee help, as my social benefit circumstances doent match ( i do not have a job and ive been jobless for past 5 years and i get Social benefit)

    in that case i have the Online form case fee 25£


    and just to clarify, the person who stole my money is over 18, has been for many years.


    Amount owed to me which i all Advance paid is under 300£. but top to that it cost me 1,5 years of work and mental depression, as the person is my friend, so he isnt just anybody to me, as i lost a closest friend ive ever had in same case.

    Make sure you don't run out of time to bring a claim. If its purely a debt matter I belive you have 6 years from the date the debt became due to enforce it, but without more information on what has happened it is difficult to know what the deadline is.

    Don't bother with getting legal advice from the website you quoted. For all I know they may be very good, but you don't need legal advice to bring a small claim, let alone at that rate. All they will do is complete the form for you, which you can complete yourself in half the time. For the avoidance of doubt, this is the site where you make your claim, the official court site:

    The issue fee will depend on the value of the claim. If it is under £300 total the fee will be £25.

    I appreciate that you have been upset at falling out with a friend, but with respect the court won't be interested in that. Enforcing a debt is purely a financial question, you can't bring pain and suffering into it (well, you can, but only if you've suffered a personal injury as a result, which wouldn't just be distress).

    I'd advise you to keep the form purely to "I gave him this money on this date for this reason, he was supposed to pay me back on this date for this reason. He didn't, so I asked him on this date, and this date. Here is my documentary evidence of the above". You don't need to go in detail into your personal relationship aside form saying he was a friend, and you don't need to go into the effects it has had on you aside from financial consequences.

    hi !

    Thanks for people in this Topic who Contributed and shared me little advice.

    i made MCOL and i won the case. since it ive been getting my money back in instalments + expenses, all inc.

    as a Courage to others if suffering the same, take the Action and make a Claim. i as a abroad foreigner to UK, was easyly able make mine without any Procedure problems.

    if any1 needs help or advice on simular issue to mine (being outside from UK and purp in UK) feel free to contact me and ask advice help.

    i know how difficult it can be Out from Blue to know where to start, as i didnt even find the correct Legal Dictionary words like MCOL or UK Gov, where to start finding out what to do. it took me all by my self something 200~400 hours+ to find the Starting spot.

    Especially as these 2 member from this Forum where the only ones in whole web/forums helping me, besides my UK corresponding friend. This topic gave me the correct web address and it was the Spot where to start the claim prosess.
