    Pleeease help Eu law exam in 2 days :( .....
    Following a dispute over agricultural subsidies the government of Spain has imposed a regime of inspections on all agricultural products imported into Spain from other member states. A charge of 5 Euros per inspection has been imposed by the Spanish authorities. Following a number of inspections under the new regime some goods have been refused entry into Spain and sent back to their country of origin. The inspections and the charge have not been authorised by the EU Commission.

    Discuss the legality or otherwise under Articles 30 and 34 TEFU of the charge, the inspections and the refusal of entry clearance to some of the goods following the inspections.

    What should I discuss??what cases can i use?

    Well why don't you have a look at the Free Movement of Goods section in an EU textbook?

    I would look at Cassis de Dijon and the rule of reason (mandatory requirements and proportionality) as well as the rule of mutual recognition. Since the sanctions have not been approved by any EU Institution then this could be argued as a meqr. Especially when viewed in the light of the broad interpretation under Art. 34. We didn't do Art. 30 on our course but I suspect that Art. 30 probably has to do with competition laws or something of that nature... Hope this helps
