If the Queen murdered me, could she be prosecuted?
This isn't fuelled by the recent rise in anti-monarchist threads, I'm genuinely curious.
If the Queen murdered me (
), could she be prosecuted? It would be Her Majesty's Advocate v Her Majesty so technically she'd be prosecuting herself, wouldn't she? What would actually happen if she did it? Is she above the law? Could she get away with it?

I think:
She can't be prosecuted in our courts for the reason you gave.
But it would be a breach of your human rights. (Having been murdered and all that...) So she would be tried in the European Court of Human Rights. And probably lose.

the Queen wouldn't touch a 'commoner' let alone murder one. Anyway she'd probably get someone else to do it.
I think she would be prosecuted, she isn't above the law.
Technically the royal immunity has never been tested....and the last monarch that tried the divine right s*** got beheaded
But saying that she'd probably get a huge cover up and the royal a**e lickers aka the BBC would go along with it cos they love her so much.

I think she can just 'excuse' herself from any charges brought up against her. Not sure about the in and outs of it. Although of course a republican revolution! (or not) would take place and her powers which are just illusionary would be taken away.
So you may be remembered as the catalyst for a huge political change within the UK, congrats. -

I think she's above the court system here (what with it being her court system), but the ECHR would most likely be able to prosecute her. -

It's an interesting concept that has never been tested. I can imagine at least huge compensations from the taxpayer if she caused damages to anyone, but actual jail I don't know. The thing with murder is that you can't arrange a monetary amount because you're dead. I can see her buying her way out of going to jail for assault, but not murder.
Hasn't something similar happened with her family?
But knowing the human rights court, they'd probably feel sympathy for the criminal, as usual, and let her off.
I believe there are precautions to prevent the Queen from committing any crime, such as running people over in a car - she gets a driver. She'll never be in the situation for causing harm to anyone.Last edited by Snagprophet; 03-06-2012 at 20:55. -

I think that parliament would vote virtually unanimously to remove her rights, and then proceed form there.
If I understand correctly, both the monarchy and parliament have the potential to remove the other...though there were some changes I cannot recall following the Civil Wars that are designed to stop that from happening without good cause. -

There's the (frankly ridiculous) conspiracy theory that the Queen/rest of the royals planned her death. -

Many countries give their heads of state legal immunity. I suspect, although it's never been properly tried, that the Queen couldn't be prosecuted. I believe when Paul Burrell the butler was in court he tried to call her as a witness, which was not even considered on merits.
The European Court of Human Rights doesn't conduct trials, and above all there's no real human right to a prosecution for a crime committed against you. In this country, we generally see crimes - from a legal perspective - as being against the state or the Queen's Peace rather than against the victim.(Original post by sammy-lou)
