It was enacted in 1998. The ECHR was from the 1950s, but - as the European Court recognises - it is an evolving document with interpretation changing to reflect changes in society.
That's what the criminal law does. It has nothing to do with human rights.
The human rights charter, which the act is taken from, was drawn up after ww2.
It is completely out of touch as it has not really moved on since that time.
Criminal law does not give people enough rights. It is reactive to crime. By giving people more human rights in relation to crime it would force the state to take crime more seriously lest they be complicit in human right abuse --certain crimes being reclassified as human rights abuses.
It would also give greater powers to the public to sue the state should they neglect their duty of public protection.Last edited by thinbeard; 14-06-2012 at 08:58. -

I would sincerely hope that any Bills of Rights would also be entrenched. I don't fancy the chance of some right wing nutters coming into power and repealing any torture clauses.
