    Drunk girls in Ayia Napa
    Whats the deal with them? If I was to get with one (whilst sober), are there any legal rules against it? Does it commonly happen in Napa?

    When you say gettingwith them i always take that to mean just kissing them, if so no not really if you mean something more untoward then it can count as rape depending on how pissed they are... considering its napa though nothing will come of it unless you do actually restraim them and do the busys in which case youre ****ed, in both senses.
    Do drunk girls commonly get with boys in napa though? oh yes, aside from the sun and cheap booze there thats most of the reason anybody goes to these holiday places ... :rolleyes:

    Everyone goes there to get drunk i'm pretty sure. Its a bit creepy though, if they are drunk but fully coherent and have only had a few drinks then its not so bad but if they can barely walk or are slurring their words majorly then don't do it.

    Whilst I agree with you, unfortunately most guys do not, or at least don't seem to give a **** after a few beers. My flatmate has woken up quite a few times unsure if she's even had sex. Now, if the guy was in the same state then fair enough but a guy can't get into that position and still be capable of sex.

    Yeah two drunk people having sex is ok, but my ex boyfriend could drink a lot and we could still have sex so its a bit of a grey area. But pretty much everyone accepts that if one partner is completely out of it and the other is sober its just a no go area, not just legally but if thats the only way you can get someone to have sex with you ... not good.

    I was planning on doing anything, just curious. I wouldn't sleep with someone who was out of it. Bit creepy and a bit disgusting. Not morally right. Alcohol breath puts me off anyway.

    I was asking more as someone who's had a few drinks and is a bit tipsy and more likely looking for someone to sleep with. I don't intend on drinking too much so figured I might as well try and take the positives out of the situation.

    Is that because he could drink a lot and not be smashed though? I was refering to that it's very difficult for men to get so drunk they can't remember having sex at all (or only very vague, idea of somebody on top, etc) and still being able to get it up, nevermind finishing.

    Legally is difficult though. Whilst you can can say if somebody cannot remember having sex at all then they're not really capable in consenting it will never go anywhere. If X admits yes they had sex and yes they consented at the time (and they were a bit drunk as well) but then Y says she would never have consented but can't remember saying yes or no then nothing is going to happen in the eyes of the law.

    You should have said 'tipsy' in the op rather than drunk then, though there is a fine line between them both. Obviously most people can tell when someone is fully in control of themselves, but you can get yourself into a lot of trouble if you knowingly sleep with someone who is very drunk, there are issues with whether your partner is in a sound mind to consent or not so it is better to err on the side of caution and sleep with sober girls.

    well you can be guilty of rape via them not being sufficiently capable to make a choice to sleep with you ergo being completely buggered you can also be guilty of rape in the more conventional sense of forcing yourself upon them even if they protest.

    I'm glad alcohol breath puts you off sleeping with girls that are not in a position to fully consent to whether or not they actually want to sleep with you. If they have a tic tac before, are you alright to go ahead and rape them anyway? Let's face it, they're drunk so probably deserve it, don't they?

    Yes on the one hand people should control themselves not to drink too much and get into the situation but its happened to me where i've went from tipsy to drunk in one drink. In the X Y situation nothing would happen as it couldn't be proven, but if X was sober and (if proven) knew Y was not fit to consent then there is a problem. (I don't know if proven is the right word it sounds good anyway haha)

    That's quite interesting. I've never gotten so mashed I couldn't have sex but I've never tried to have sex when I've been totally balls to the walls plastered.

    Oh yeah, the difficulty is it's impossible to prove though. You cannot legitimately say X was sober and Y was paraletic apart from other witness statements which are difficult to attain and unreliable (they've probably been drinking as well).

    The story I remember was the footballer who picked up a really drunk girl with his friend when he was sober and there was cctv and a witness in his hotel and he was convicted so its not completely impossible. I was so drunk once that I blacked out and had sex with my boyfriend then not remembered the next day, but obviously I consented to it so again there is a grey area.

    Yes but the op says specifically that he will be sober looking for drunk girls then asks if it is legal, it does sound a bit sinister.

    The original post says "If I was to go out sober". Casual sex is fine, as long as both parties consent. When one is sober and one is drunk, that is rape.

    Why? As long as they aren't too drunk to decide whether or not they want to have sex with him then it doesn't matter if he is sober or not.

    Yeah thats fine if they aren't completely legless, but I don't understand why he had to ask if it was legal to have sex with a drunk person, in one of the biggest party destinations I know of? I just hope i'm being overly sensitive about it.
