In January 2009, Jenny visits an adventure theme park owned by Thrill Enterprises Ltd, paying an admission charge which entitles her to unlimited rides on all the attractions. She joins a long queue to ride on the ‘Gravity Buster’. The queue enters a 100 metre tunnel at the end of which the customers enter a car and are strapped in by Phil, the attendant. The car then plummets down a deep shaft into darkness. As she approaches the end of the queue, Jenny suffers a panic attack as she hears the loud screams of those travelling on the ride. She refuses to enter the car when it is her turn and tries to push her way through the crowd behind her. Phil seizes her by the arm and tells her she cannot go back that way as she is a danger to the other customers. Jenny demands to be let out and struggles to free herself. Phil pushes her into a small storeroom, telling her she will have wait until another attendant comes on duty. Phil will then take her out through the staff exit. After 45 minutes, the other attendant arrives. Phil escorts Jenny out through the staff exit. Jenny is angry, distraught and has sustained severe bruises to both arms as a result of her handling by Phil. Consider the potential liability of Thrill Enterprises Ltd in trespass.
