Job+Criminal Records...
Hi there,
So I was going to apply for a job for which you need a clear criminal record.
Now I'm not one of the big bad guys, but I got a complaint about noise in my earlier days... like 8 years ago or something. Now of course I'm worried this will keep me from getting the job because as I said, I need a CLEAR record.
Will this even be in the record anyhow? I mean it's a minor/first offense thing and I only had to pay a fee. Besides, it was not even me who was making the noise. Argh.
Any help with this would be greatly appreciated. -

You would be very hard pressed to get a criminal record for a noise complaint. Unless it was excessive, and you did something along with it, such as abusive or threatening etc, I doubt it would ever go that far.
Do not worry, there will not be anything on your record.

I think paying a fine is like a parking fine, just to discourage that kind of behaviour.
To get a criminal record you'd need to be charged (afaik, on the whole), and it would go to court usually, where you'd plead guilty/not guilty, etc.
It's evident how much a criminal record can divert someone's life and affect them greatly; so they would not hand them out for a noise complaint unless you did something to accompany it, like I said earlier. -

Do they record these things in Austria? It is unlikely someone here would be able to answer your question, since people here do not normally get fined for making noise unless it is clearly repetetive and they are taken to court for anti-social behaviour that has gone on over a long time- at least several months of nuisance at least.

Don't risk it, I got caught for littering and did not go to the court to settle it and it came up in the job interview low and behold 6 Police vans there to lock me up. 6 months later I **** out golf balls.
Even if that's the case I cannot possibly see how this could be true.
That they knew you'd dogded court for littering somehow came out in the interview?
Six police vans rushed to come and pick you up before you left the scene?
Six months imprisonment?
Utter rubbish. -

You don't have to declare it after 5 years if you were not sentenced to prison. It is longer if the crime committed caused you to be subject to a certain length of imprisonment. 7 years for prison sentences of up to 6 months and 10 years for prison sentences of between 6 months and 2½ years. Locked up for longer than that, you always need to declare it if asked.
Oh, and you always have to declare it regardless if the job requires a CRB check. -

Although on the face of it they'd be pretty pissed off that it was shown that you lied to them when the CRB came back they would quite easily assume that the offence had been dealt with, there is nothing on the CRB to indicate you are a fugitive.
Even if you dropped yourself in it by admitting you were a wanted criminal who had dodged a court appearance, which would have been an incredibly dumb thing to do, I can't see them calling the police for something as mundane as littering.
There is of course a vanishingly small chance that the police were alerted that you had applied for a job requiring a CRB whilst still 'wanted'. But in that case they would have gone to the home address as on the CRB form that you have had to prove was valid and you would have been picked up long before the interview.
So to summarise.
You were fined for littering, didn't pay, didn't attend one or more court appearances or misbehaved in court...
Ostensibly changed your address to go on the run from the police as they were obviously so keen to pick you up, judging from the fast response...
Applied for a job with a CRB, told the company you had a clear record, but when the CRB came back to them they invited you for interview (presumably you knew about the failed CRB as you get a copy also?)...
Went to the interview, they told you you hadn't disclosed an offence, then they called the police - why? Because you told them that you were wanted?...
Police turned up, took you away and then you went down for six months?

Re: Job+Criminal Records...Assuming you got the fine in Austria and you are applying for a job in the UK, then I think the following will apply. The UK employer will use UK law in determining the significance of your history. In the UK a fine for noise would be a civil offence and not a criminal offence so would not be declarable, and anyway would be well outside the time limits for reporting for all but the most intensive security checks. So you have nothing to worry about in the UK, but you should probably declare it anyway, that way if it does come up on any checks, it won't be a surprise to the employer.(Original post by Nord)
