Evidence!

Hi,

I was wondering if anyone could help me. Ive undertaken an evidence module and need some help with my assignment. The question is how do courts determine who bears the burden of proof in criminal cases and to what extent is the presumption of innocence respected.

Can anyone shed some light on this?

I have mentioned the legal burden and the evidential burden but they are quiet confusing. I do not understand how the courts determine who has the burden.

And being ill doesn't really help since I have to hand this assignment in soon. Eeekk :frown:
