sychalts is a Nigerian citizen from the Yoruba tribe. She is aged 28 and came to the UK on false papers in 2008 with her 2 daughters who are now aged 6, and 7. sychalts has been living and working illegally in the UK ever since. She has recently come to the attention of the authorities when they raided her place of employment and discovered that her ID document and passport are forged.

sychalts was served with a notice of removal on 20/02/2014. On 03/03/2014 she claimed asylum. She states that she married her husband Bolu in 2006 and went to live with his family in Badgirlriri. When she first got married everything was fine in their relationship, however her husband changed towards her after their first daughter Chiamanda was born. His family wanted the baby to undergo female circumcision (FGM) because they said it was that their family tradition to do so. sychalts was unaware of this before she married, but she opposes the practice. She managed to persuade her husband that the FGM should not take place until the baby was older; however he placed her under a lot of pressure. She then got pregnant again with her second daughter and suffered from poor health during the pregnancy. She persuaded her husband to let her and Chikwambe return to Lagos where the medical facilities were better and her mother could look after her. Her second daughter loula was born in 2005 and bolu then tried to insist that she and the girls returned to Badgirlriri for the FGM to take place. She agreed to do so because she was frightened of him, but secretly arranged with an agent to obtain forged papers which she then used to obtain a visit visa to come to the UK.

She states that she did not apply for asylum when she first arrived because she did not know about the system and was just relieved to be somewhere safe. She was able to stay with her cousin and has been working since the girls started school. She is frightened to return to Nigeria because she knows that her husband and his family are still looking for her; her mother has told her that they keep phoning demanding to know where she is. She could not live with her mother because she is old and frail. She has no other relatives who could look after her, and would not be able to move to another area of Nigeria. She would not be able to protect her daughters from FGM if they returned. The girls are doing well in school and cannot remember living in Nigeria.

What arguments will you will make to the Home Office on sychalts’s behalf to try to enable her and her daughters to remain in the country. In formulating your arguments you may want to consider and refer to country guidance case law and country of origin information for Nigeria.

You should also use any other authorities you think may be relevant. You will need to try to anticipate and counter any arguments the Home Office may put forward to refuse her application.
