Failing a Law core module in first year??

Im at sussex uni and i have heard that if you fail a module of Public Law one, then this can affect whether you obtain a full qualifying law degree or an honours degree, i just wanted to know whether this is correct and if it still applies even if you retake ?
Usually if you fail a core module (less than 40%) You have to resit it in September. If you fail again, most likely to be kicked out.

Can't have a qualifying degree without passing the core modules.

Sussex's policy is if you fail you can retake in August, then if you fail again possibly next may (subject to departments discretion). Your marks will be capped at 40%.

What would be the point of completing a degree capped at 40%

The degrees marks arnt capped at 40 that specific module's marks are.
