Okay,

So I have a contract question. If you reply to an offer saying you accept but you add your own terms and conditions,then this constitutes a counter-offer. The person you are responding to sending you the product you are contacting over without amending any of your terms or anything.

Does that mean your terms apply or the original Offeror's terms?

Once you amend, strike term out of the original offer, it becomes a counter offer. If this is accepted by the other party (ie the offeror) then contract exists subject to your terms.
