Christoph, hoping to sail across the world, found Danny’s website. Danny is a very good boat builder. He called Danny and they agreed that Danny would build him a boat according to a specified plan for an agreed price of £60,000 to be paid on completion within 12 months. When Danny was close to completion, he ran into financial difficulties which caused delays. Eventually, he told Christoph that he would be unable to complete unless Christoph agreed to pay another £5,000 on completion. Christoph agreed because he was desperate for the work to be done as soon as possible. When the boat was completed two months late, Christoph refused to pay the additional £5,000. He was also unhappy about the lateness of completion. However, Danny’s Terms and Conditions on his website state that he would assume no liability if completion occurred within no more than three months after the agreed time, due to circumstances beyond his control. Christoph was not aware of this term.
