3 certainties and gift

    1. Ann died, in her will, she made the following gifts:
    (a) best book to my friend Jane.
    (b) GBP 100 to my former colleague in McDonals.

    In regards to (a), there is no certainty of subject matter and (b) there is no certainty of objects. Does it mean since there are no certainties, it would not deemed to be a valid trust therefore is a valid gift?

    2. As for the application of 3 certainties, as long as one certainty is not available, it would not deemed to be an express trust?
