Even if she was there I doubt she would have went near the alleged rapist.
If she went near him, I HIGHLY doubt she would have intercourse with him.

But. OP chose to drink. As an adult, she should be aware of the dangers of drinking too much.

How long was the sex after the drinking? I don't think anyone's going to claim you can consent right after a litre of alcohol, but it's possible to have capacity 12 hours later, for example. Also, he may have been drunk himself.

As to the morning sex, he didn't carry on anyway. He asked multiple times, and she felt comfortable saying no. No real solid reasons have been given re what made her change her mind, other than persistence and the fact she was smoking his cigarettes.

Yes people don't ask for permission, but there is a difference between someone is stating that they want to do it again and not stopping even if the person refuses (which is what happened) and then there is someone who wants to do it again and doesn't carry on (that didn't happen). The first one would be classified as a rape, that did happen.

He carried on asking, he didn't carry on with the act itself. Asking for sex isn't a crime (other than maybe sexual harassment) providing there's no clear or implied threat, even if the manner in which he did it is unpleasant.

No but when you are walking on the side walk and you see a group of youths on BMXs and hoodies crowding on one side of the road, you dont walk through them do you? You cross the road.

EDIT: Thats abit of an iffy point. Most people dont get murdered for little to no reason.

I'm not screaming rape, but for anyone to think that is a normal situation is absurd. He wanted to do it again, that is all we know, she refused and told him to put a condom on (for obvious reasons) and went along with iT anyway. That isn't consent.


I'm actually tired of typing the same thing out repetitively. For anyone to think this just a normal every day occurrence, it's just sex with regrets is disgusting. She didn't want too, which was made clear in the morning.

They don't deserve to get murdered, but like it or not, there's probably gonna be an extra hole somewhere on them.

Not after the first time, not after the second time (we don't know how many times). He carried on asking. As far as we know ("he still tried" is open to interpretation) he didn't do anything beyond that until she agreed.
