I am about to start and Open University course of two 30 credit subjects. I understand that the OU is generally classed as part-time but studying the two subjects is more full-time than when I was at 'full-time uni'. Am I able to apply for a maintenance loan? and If so, can I back date to last year as well when I undertook the same course (I had to defer just before the end of the course due to personal reasons and am now starting the year again)

If you are doing a course with Open University then you apply for part time funding, therefore you are entitled to tuition fee loan only.
