Question Judicial Review... PLEASE HELP!
 
Hey all, just wondering if anyone could give me some tips on this seminar question concerning Judicial Review...

As a Public Law Company the duties of BioMedic are defined by statute, which states that all experiments must be approved by the House of Lords. This experiment was conducted without approval.

Explain whether the decision could be challenged? And on what basis?


Any advise to get me in the right direction would be great thank you

Is a rubbish question to be fair, but:

Illegality
Breach of statutory duty (strict liability?)

Judicial Review is an action for review of the executive.

You need to get clear in your mind:
1) Who wants to get what anulled
2) Has he got standing?
3) Has he got a valid ground?

Its really just a matter of getting the grounds for Judicial Review clear in your head, in list format, with the requirements for each. You then just run through each ground and look at whether it is met.
