Abei decides to hold her wedding at the Wendy House Hotel. She enters into three separate contracts with Luxury Limo Ltd (‘LLL’), the Customade Cakes Company (‘CCC’), and Pronto Precision Photos (‘PPP’).

Five days prior to her wedding Abei phones LLL and enters into negotiations for a limousine to take her and her future husband to the airport after the wedding celebrations have finished. LLL inform her that they have an excellent reputation for being reliable and give her a list of previously satisfied customers to check that what they have said is true. Abei does not read the list. In fact the list contains a number of complaints about the condition of the limousine. LLL charge her £400 for the hire of the limousine for the whole day, commencing from taking her from her home to the church. On the day of the wedding the limousine fails to pick Abei up from her home and she has to phone a taxi company, who charges her £150 for the fifteen-minute journey. The limousine eventually arrives at the church at 1:00pm. On their way to the airport the limousine runs out of petrol and Abei and her husband miss their flight to the Bahamas. As a result, they have to pay an extra £500 to Rip-Off Airways for a later flight and lose their hotel booking deposit which costs them a further £1000. When Abei returns from her honeymoon, she discovers that LLL are unreliable and have been late on five previous occasions (i.e., four weddings and a funeral).

Abei also contracts with CCC to make a special wedding cake. The cake is to be rectangular in shape, three tiered, with writing in icing sugar which says ‘WEDDING OF ABEI AND BRIAN.’ When the cake arrives on the wedding day it is circular shaped (although it is the correct size overall) and reads ‘WEEDING OF ABEI AND BRAN’. Abei is extremely disappointed and breaks down and cries. CCC refuse to take back the cake and instead offer her £75 compensation. Abei refuses their offer. The cost of the cake was originally £400. Abei does not offer any of the cake to her guests.

Finally, Abei contracts with PPP to take photographs of the wedding ceremony and the celebrations afterwards. She had used them before on seven occasions in the past year as part of her job as an events’ organiser. When the photographer from PPP arrived he immediately began taking photos of the newly-married couple and prior to them leaving for their honeymoon handed Abei a contract (which she had previously negotiated with PPP) on which were written the terms and conditions, including the words, ‘Although Pronto Precision Photos will attempt to do the best they can but we do not accept any responsibility for the quality of the photos taken.’ It turns out that seventy-five percent of the photos were distorted and blurred and the remainder were made up of blanks.

Advise all the parties involved as to their contractual rights.
