Private international law exists to resolve these situations hence it is called conflict or comparative law. These rules will alrady exist. If you didnt have them and didnt start off with respecting that other people do things differently and where possible you should respect that then you would have the situation nobody respected anyone elses laws. In this case if you didnt get narried the danish way then you arent married, even though its accpeted in the home country. There are ofc limits and this is what the gvernment has decided to try and tackle, bt its more a cack handed way of dealing with anasylum issue and what they believe is an attempt to defeat it. It looks illegal anyway.

I don't think this has much relevance to PIL; the Hague Marriage Convention only has 6 signatories.

If Denmark stops recognising, say, Saudi child-marriages, I'm sure they won't mind if Saudi stops recognising Danish marriages (given there is no recognition of same-sex marriages conducted in Denmark in such countries anyway)...

You dont seem to grasp what the issue was about. Read the article.

As for private international law it is the way courts resolve conflicts between different legal systems. Its a whole area of law. Thats why you have international lawyers who specialise in the area.

Agreed. The Japanese got it right. Send lots of money to help alleviate their suffering (persecution by other Muslims) but don't let any in to live. Or you get problems like this in the short term and worse down the line.

Japan for the Japanese. That is their culture. Cultural relativism cuts both ways...
About time, but why on Earth are the bleeding heart Greens opposing it? I thought they were meant to be for human rights and all that?

And this shows some of the problems with non-recognition. The woman was 19 when she applied to come to the UK and the decision was handed down when the woman was 21 and still wanting to be reunited with her husband. She could have been 41. If your marriage isn't recognised, it doesn't somehow become recognised by the passage of time.
The only thing I take issue with is the cutoff age... why is it 18 and not 16?

Say an 18 year old marries a 16 year old in x middle eastern country, why should their marriage be delegitimised?

(I can understand it for 40 year olds being married to children and all that however)

Why should the 17 year old who marries the 15 year old's marriage be delegitimised?

What you are really doing is a bit of cultural imperialism at the expense of the Danes. You feel 16 is the correct age because it is the age in the UK.

I'm not exactly forcing them to change it am I? Just stating my opinion.
I'm sure the Danes wouldn't be totally disgusted if the legal age for marriage was reduced to 16...

Well that's not really for me to decide, but I was getting at the fact that if two people apply for asylum (with that age gap) in Denmark who are married, then the chances are it's a sham.

It may be a sham. It may be non-consensual. It may be a cultural expectation.

But those are different issues from whether the age of the parties renders the marriage void.
