R66 – Ministerial Report from Her Majesty's Secretary of State for Digital, Culture, Media and Sport - Response to M611Image
Recently a motion was passed by the House which opposed the removal of television shows from on demand services if they could be considered offensive, and supported freedom of speech being given equal consideration with offensiveness in broadcasting standards. I have been a champion of freedom of speech for the whole of my career in this House. When I was a Libertarian backbencher I wrote the Freedom of Speech Act which repealed so-called ”hate speech” legislation and although my political affiliation, as well as many of my views, have changed since then, I still support the right to speak freely.

In line with this, it is important that we retain the right to speak freely within comedy. Firstly, content which was considered acceptable in the past should not be deleted because it is viewed as offensive today. I have no problems with content warnings that inform viewers that the comedy may be dated, but things should not be removed because some people view them as unacceptable today.
Furthermore, comedy, by its nature, involves making fun of something. It is dangerous to say that we can make fun of some groups and not others; all people should be targets in comedy, and to make some things off limits is a slippery slope to go down.

As such, my Department will be taking action to support freedom of expression in comedy and to ensure that there are no sacred cows, so to speak. I will use my power under s323 of the Communications Act 2003 to modify s319(4) of that Act by adding the following text to it:
”(g) the need to ensure that British television and radio is a place of truly free expression, and that the importance of freedom of expression should balance out the duty not to be overly offensive”.

Mr Speaker, I hope that that Ofcom keep freedom of expression in mind when enforcing regulations, and that any new regulations make sure to give freedom of expression the same status regarded to consideration of offence.

Mr Speaker, I commend this Ministerial Report to the House.
