    i had this exact same issue with my 3gs. it was a faulty silent/non-silent mode toggle switch thing. apple will replace the phone for you if you book an appointment at a store.

    My 3GS silent switch is faulty and keeps making the phone vibrate at the slightest touch... only problem is I got the phone in June 2009 and it's out of warranty. Did you do this when you'd had the phone less than 1 year?

    ah, yeah, my phone was in warranty. technically it should have been out of warranty as i got my 3gs in november 2009 but i had it replaced in may 2010 as the speaker just stopped working :p: (i.e. i'm now on my 3rd iphone).

    i highly doubt they'll replace your iphone if it's out of warranty, but you may as well book a "genius bar" appointment and try.
