    This is basically my view of the incident. She was either too drunk to consent vs both of them, or she wasn't drunk. If she want not drunk, surely it is his word against hers, and as a result no conviction.
    It's not her word against anyone else's - by the first appeal, even the Evans lawyers accepted that she didn't remember anything about it (another sign of how drunk she was...)

    It's his and McDonald's words against himself. McDonald could argue a reasonable belief in consent, but he couldn't.

    Have a go yourself: you've turned up uninvited, unexpected, and unwanted in a room where a mate and a woman you've never exchanged a word with before are having sex. You (should) know she's extremely drunk: you stepped over her slumped on the floor earlier. You don't bother to ask if she wants to have sex with you, your mate doesn't ask, and no-one - including the pair you sent to the window to get the humiliating film of them - says she asked you to have sex with her. Or any of the "numerous" "calling out" "**** me harder".

    What makes you think she wants to have sex with you? Hint: being a 'famous' footballer who boasts to police that he can get a girl whenever he wants doesn't count as a reasonable belief, and neither does 'Well, if she'll shag him, she'll shag me...'

    I always felt the evidence was clear, but weird the other guy in the case was let off. He's been so insistent that he's not guilty though.
