      Depends, it happens every weekends where clubbers will wake up in strangers bed's with no clue how they got there but knowing they probably had sex. There does seem a bit of an assumption that if a man wakes up in a strange woman's bed then your supposed have gotten 'lucky' that night.

      If two people wake up and neither one has any clue how they got there despite it being clear they had sex, then unfortunately i would presume even if they were both just as intoxicated and neither one had any remembrance of potentially even meeting each other it would be the male who would potentially end up being classed as the criminal whilst the girl the victim.

      If they were both so drunk they have no recollection of the night and just woke up in bed the next day, how do you answer those questions?

      Well if you are just drunk, but had a perfect memory of what happened how would it be any different than a sober rape, there would be no trouble deciding if it was rape and the victim would have known at the time.
