It's because you haven't watched enough of it. It took me a while to say it was my favourite show I didn't start watching and half way through season 1 say this is my favourite show. You don't really appreciate the true quality without rewatching as there is a lot you miss first time around watching it!
I'll watch a few more episodes if time permits, and then I'll make a decision. However so far, it seems very overrated.

Not necessarily my favourites but certainly intelligent, creative and well written. Jonathan Creek. And also a show that may linger in the memory of a few: Crime Traveller. There were only 8 episodes back in 1997. I think they're on youtube.

Edit: Actually, maybe the writing on that last one is a bit cheesy. But the stories are clever. And I just googled it. Apparently, the week after Crime Traveller ended, Jonathan Creek began.

The X-Files, without a doubt, is a very intelligent and well-written TV show at times. It can be very thought-provoking.

Same for Pushing Daisies.
Agreed! Pushing Daisies was great while it lasted. Luther on BBC1 is really gripping for a police drama too, Idris Elba has a way with making Luther as a character completely believable.

Has anybody been watching Falling Skies? It's a new sci-fi drama set post-genocidal alien invasion. It's something to look out for, has good potential.

I think law and Order: SVU is a top show for this category. It's different to the other two L&O shows as it builds proper back stories for the main characters and has a lot of emotional material, being about sex crimes and crimes involving kids.

Other than that, I'd say the mentalist (obvious), scrubs (again, obvious) lost (the thing about that show was that if you ever missed an episode, you'd be totally ''lost''), and being human (really built on me).

Oh yeah, and House!
