Contract offer and acceptance essay. Help please! :(

Hi guys!
I'm just wondering if anybody could help me with a 1000 word essay i need to do which needs to be in for tomorrow :frown: haha. It's on offer and acceptance, but i am unsure what i need to include in it and what order i should write it in. Any help would be very very must appreciated :smile:


The Question:
On 1st September Finch wrote to Barnacle stating ''I have a first edition of Darwin's 'Origin of the Species' for sale at £6000, acceptance to me by written communication to my office by 10th September.
Barnacle received the letter on the 3rd September and immediately wrote to Finch stating: ''I accept your offer, can i pay by 6 monthly installments of £1000?''. Finch received this reply on the 5th September and wrote to Barnacle withdrawing his offer. The withdrawal letter was posted on the 6th September but did not reach Barnacle until 9th September.
On 8th September, Barnacle, having received no reply from Finch, emailed Finch at 5.00 pm the same day saying: ''I accept your offer at £6000.''. Unfortunately Finch was out of the office and did not read his email until 11th September. Finch, thinking he had withdrawn his offer, had sold the book to an American collector, Turtle, on 10th September.
At first instance, the County Court found in favour of Finch and Barnacle now appeals to the Court of Appeal on the grounds that he validly accepted Finch's offer.

You are required to represent Barnacle.

hey guys really need help on my law essay to..i just dont know how to structure my essay :/ the situation is:

On 11th December, Jock a wholesale poultry merchant made offers in writing to Angus , Bruce and Collin all managers of large supermarkets. The offers each in identical terms were conveyed the same day by Willie, Jocks delivery man.The read as follows: I offer to sell you 100 ten pound turkeys for $ 800 cash on delivery. If you wish to accept please give my delivery man you acceptance in writing to facilitate a swift transaction”.
Angus gave Willie a letter that said: I accept your offer. I assume that payment by check will suffice.”
Bruce decided to consider the offer and Willie left without any message for Jock. However later the same day Bruce send the following fax to Jock I accept your offer. Will pay cash. Delivery witin 7 days”. Jock received this fax before Willie had returned from making his deliveries.
Collin decided to accept the offer but instead of giving Willie a message he send a letter.
Advice Bruce, Angus and Collin, whether they have a legally binding contract with Jock. State the reasons for your advise.

I know in some of the textbooks it has been the custom to do so; but, as I understand the law, there is no need to look for a strict offer and acceptance. You should look at the correspondence as a whole and at the conduct of the parties and see therefrom whether the parties have come to an agreement on everything that was material…” (per Lord Denning, Gibson v Manchester City Council [1978] 1 WLR 220, at 523)

With reference to the above statement, outline the main rules of offer and acceptance and critically assess whether the law in this area is sufficiently clear, supporting your answer with appropriate case authority and commentary.
