If an item is described as being 'new without tags', how do you know it's really new?

you can give negative feedback if it is bad.
If they are a powerseller, they will not relish that kind of thing and so should be selling you undamaged goods

I think I'll bid on it, and then try to kick up a fuss if I win and it arrives and it isn't what they said it was.

well, have you tried emailing him? Ask him if it is really new, or just a returned/refurbished good. If he is a regular seller, he should be offering 7-14 day refund.

I'm about to put up some new armani jeans and tops with out tags. When the winning buyer recieves the item s/he will instantly know if the product has been used, by the feel, smell, etc etc...if you are unhappy you can always return the item, but contact the seller first and make sure he/she is open to this option
