Urinating in public.

Right so. Left a club tonight with a friend, couple other of the lads were inside. It was general "kick-out" time so me and another fellow, Ben, were outside waiting for the others. After a couple minutes Ben needs to have a leak. So we can't get back into the club, so go up the street and into a parking lot behind the club. Walk down to the back of it and Ben starts urinating behind a van.
Police pull up out of nowhere and see Ben as he is zipping up his fly. One gets out and looks at his ID, takes down details in his little notebook and informs Ben that he is going to go to court, for public indecency - urinating in public, having his cock out. Tells him it's a sexual offence. Ben and I start reasoning with the policeman, saying it was out of the way, behind a van, no-one actually saw, no toilets available etc. but he is having none of it. Tells Ben he will receive a letter summoning him to court. Could even possibly go on the sex offenders register.

So basically, is Ben screwed? Obviously that is not his real name. And Ben isn't me, by the way. I'm a complete villain compared to him. Can I support him in court? Helpful replies please. Thanks.

Edit, oh and this happened in Northern Ireland, so I'd assume standard UK laws would apply.

Go to the Citizen's Advice Bureau for move advice.

it is an offence to urinate in public unless you're a pregnant women. I've never heard of people being done for indecency for this before.

He will most likely get a fine and maybe some community service, or maybe just a caution if he's lucky.

Be polite and apologetic to the magistrate. etc...

In general, if they care, they'll give you an on-the-spot fine and tell you to **** off. What they did was probably just to scare you.

My mate just got a warning and an £80 fine. I've seen girls do it aswell at the end of nights. :s-smilie:

To be fair here, you cannot possibly think it's acceptable to urinate in a public area, whether or not someone can see you. :s-smilie:

Next day, someone is going to be walking over this area of land and, if it were me, I would rather someone hadn't urinated there the previous night.

That said, sex offender seems a bit inappropriate; it's hardly a sexual offence. More like anti-social behaviour...

No. He's a citizen, as they say in the Wire! Clean record, never done anything illegal, never mind being caught for it.

In general, if they care, they'll give you an on-the-spot fine and tell you to **** off. What they did was probably just to scare you.

Not sure - where I live is one of these little semi-local places where they have a weekly newspaper that publishes misdemeanors, like speeding, no TV licence etc. I think I have seen other unfortunates in court before for doing something similar. The policeman in question seemed to be a humourless bastard, also. Hopefully he has just got a caution, anyway.

Did he charge him with it, usually you'd get arrested and charged with public decency with that. If he didnt do that surely he wont get a court summons.

I wouldn't expect Ben toi get snything through the post. He couldn't be done for a sexual offence if he wasn't erect.

Public indecency is just having it out at all.

They probably wont do anything, i reckon if he was going to get done for lewd conduct they'd probably have taken him to the station, especially if the sex offenders list was an option. He may get a fine for urinating but that'll be it.
