Speed Awareness Course - could i appeal?

I was caught doing 40mph in a 30mph zone. The roads change intermittently from 30 - 40 for about 3 miles, and i genuinely thought it was a 40mph zone as it is not well signposted.

I have read online that the threshold is 39mph to get offered to do a speed awareness course, if i tried to appeal to get one what are the chances i'd succeed?

Not much. You can ask I guess, but the police are under no requirement to offer the course at all, its just something there for people who are just slightly over the limit. You were 10mph over the limit, and confess you were doing 40 in a 30. As much as I have sympathy because everyone speeds, everyone also knows the rules.

isit your first speeding offence?

yeah it's my first offence
If you're going to admit to speeding (ie you've no intention of going to court over it) then you have nothing to lose by writing a letter along the lines of "Given that alternating prevailing speed limits.... would you be prepared to offer me the course instead?"

But I don't fancy your chances.

So what does street lighting mean in the absence of signs?
That's in the highway code that you should have studied for your theory.. street lighting and no signs is 30.

But if going from 40 to 30 there should be a clear sign of the change.
