Biscuits and cakes are considered a necessity by UK law and are zero rated. Chocolate-covered biscuits however are a luxury and subject to VAT at 17.5%. McVities and HM Customs & Excise2 argued over whether the Jaffa Cake was a cake (no VAT) or a chocolate biscuit (lots of VAT). The argument had to be taken to a tribunal (kind of like a court) to be resolved. In the end McVities baked a 12" Jaffa Cake which convinced the tribunal Chairman of the general cakeiness of the Jaffa Cake.

but....but...that would involve someone having to buy jaffa cakes and not eat them. That's just too cruel, even in the name of science. :eek:

Jaffa Cakes are already soft

so either: They're already stale and they are biscuits

Or they'll go stale later and they are cakes

I actually think that they're cakes, cos they do go harder after time

etymologically, a biscuit is a cake which has literally been baked twice (i.e. for twice as long) - "bis" and "cuit" - twice cooked.

the texture of a jaffa cake would actually suggest that it hasn't undergone the same type of cooking time as most other biscuits, so i would have to say it's a cake, albeit a very small one.

In my parts this is an age-old debate. Some argue that since they're placed with biscuits, Jaffa cakes are biscuits. Some though say that they've got cakey insides, and so are cakes. What does everyone think?


I reckon its in the rules that every member must start a thread on this topic at some point in their TSR lifetime. :rolleyes:
