I have to analyse this case and the decisions of the Employment Tribunal and the subsequent decision of the Appeal Tribunal with respects to statutory interpretation.
I am confused on one matter however. If the Tribunal had interpreted Section 7(1) exempting small businesses to include Colt Group Ltd, would they then not have jurisdiction to hear the case, or would it just mean that the disability discrimination act did not apply? Or both?
I'm just reading over my answer to the question and I can't actually remember where I got the whole "they would have no jurisdiction" thing from.
