A police officer was chasing the defendant and told him to stop running otherwise he would fire

However, the defendant is described as someone "hard of hearing" would that be a defence to them in Law?

If so, what defence would it be?

In my scenario question, it says that the defendant was drinking, so could I use voluntary intoxication as a defence?

any advice would really be appreciated thanks
