    Having alot of problems writing my essay on Overreaching !!


    Here is the question ...

    Law Commission Working Paper No 106 "Overreaching" begins:

    "Thomas holds a house on trust for himself and Sarah. She lives in the house. Without consulting her, he mortgages the house to a Bank and vanishes with Rachel and the money. Sarah cannot be evicted by the Bank: her interest is overriding [Williams & Glyn's Bank v Boland]. But if Thomas had appointed Rachel as a second trustee before mortgaging the house, Sarah could be evicted: her interest would be overreached [City of London Building Society v Flegg]. Can these different results be justified?"


    I have most of my essay done, just struggling to think of what else to write, i was thinking i should write about the exceptions to overreaching, Restrictive convents, equitable easement and estate contracts?.

    Also does anyone know any good cases or journels i could use, i have a few but could do with some more. Any other pointers would be helpful.

    Are these things relevant to the question? I don't think they are, resist the temptation to just write all you know about the general area

    Difficult to give specific advice given that you haven't said what you have already considered, but be sure to take a step back and think about the question in very broad terms
