Plz could someone give me some tips on how to answer this. A structure would be good. What are the main articles that have been infringed? I know, article 10 is obvious, but any others?
Saoud, a journalist and anthropologist, wrote a newspaper article criticising the management of synagogue A. The article did not contain attacks on religious beliefs. It did not criticise Judaism as a whole. The article aimed primarily to examine the scope of a particular doctrine and its possible links with the origins of the Holocaust. It aimed at contributing to a discussion on the possible reasons behind the extermination of Jews in Europe. A conservative Jewish association complained that the article defamed the Jewish community. The Council of Europe Member State’s courts allowed the civil claim to be lodged by the association. The national court found that some passages in the article undermined the honour and character of Jews and, more specifically, the Jewish community. Saoud was found guilty of publicly defaming a group of persons on the basis of their religion. He was ordered to pay the association EUR 1,500 in damages and to publish a statement concerning his conviction in a national newspaper. Saoud unsuccessfully appealed on points of law.
Advise Saoud as to his rights under the ECHR.
