but would the other hours not be took up from breaks and i also do after school lessons each week? and is there a chance they might not notice as im already getting ema

You need 21 'guided hours of learning' a week. They may not notice as you or already getting it - or they may realise later and ask you to pay back everything you weren't entitled to.

at my 6th form, we only need 12 hours of lessons a week to be entitled. i have a two week timetable and one of the weeks i only have 13 hours of lessons so i have to attend all my lessons or else i wont get my ema.
