    Let's imagine a girl wants to sleep with you and is like totally drunk and you are pretty drunk too but she thinks you are someone else and then has sex with you and the next morning she wakes up naked with you naked as well in your bed and starts screaming...

    I would actually film it for 2 reasons

    1) evidence incase she goes mental in the morning
    2) cos it's just damned fun to record a naked drunk girl for later viewing pleasures

    I did not say it happened. I am just saying that maybe this girl woke up naked with a naked guy and then started saying "Tommy" and then you turn around and then she starts screaming.

    But the night before she really enjoyed it thought and you think she may even had had an orgasm because you lasted about ten minutes or so which is more than you ever did before. And you were kinda drunk too.

    So, if a 10 year old child is yelling the same thing, would you argue there is informed consent in that instance?

    If she's drunk, there's no informed consent and thus it's rape, according to the law.
