Are the laws the same for girls?

Hey, i was just reading the thread about the guy who was concerned about the age of the girl he slept with. and i started wondering if lawas are the same for girls, for example if i was in a club and pulled a guy who said he was 18, i took him home and slept with him and it turned out that he was only 15 or so would i be jailed. I don't see why the law shouldn't be the same for girls but you can never tell will these things and i've never heard of a girl having sex with and underage guy, with or without knowledge.

The law is only there to stop girls from sleeping with anyone until they're 16, it's not really that bothered about boys. That's what I hear, but I'm sure someone with more knowledge will go into more detail for you.

No, there isn't a rule.

If the girl is underage, no matter how old the boy is, the boy can be held for prosecution.

However, if the boy is underage, there are no rules for girls. x
And you wont get jailed :/ thats just being dumb

Actually, what is quite suprising is the law isn't different. In the sexual offences Act 2003, only a man can rape a child under the age of 13, because its penile penetration only. (section 5)

But any sexual activity with a person under the age of 16 (by someone over the age of 18) is liable, on conviction on indictment, to imprisonment for a term not exceeding 14 years. Section 9 states that if the over-18-person is penetrated (vagina or anus) by a part of the under-18-persons body, they are guilty of an offence. So therefore there is gender mutuality.

This is subject to whether the older person reasonably believes that the younger person is under 16.

yeah you're right. But the law is any sexual activity with a under 16; thats what i was refering too.

No, completely opposite. See my post. If convicted they could get a max of 14 years imprisonment.

Well, if he actually raped her, regardless of how old he thought she was, that would have been an offence.

If what they mean is a guy had consensual sex with a girl he thought was 13 (and therefore in itself rape) but she turned out to be older, then that would be fine.

the same rules apply... but the person can get a maximum sentence of 5 years (of if in the magistrates court - 6 months).

Bear in mind the age of criminal liability - so if very young, it is extremely unlikely that any action will be taken.

Also, it must be noted that although this is the law, it is possible that a decision to prosecute wont be in the public's best interest and no action will be taken. (especially is both are underage).

If the girl was over 18, and the boy was 15, the girl could be charged with sexual activity with a child. Gosh, you don't half get alot of people posting doodoo when it comes to the law!

However, the sexual offences act does give leeway for reasonable belief that the minor was of consenting age, but that's for a court to decide.
