contract law / help / acceptance by email watch

    • Thread Starter

hi i am having real difficulty getting my head around this question as i only study law an hour a week as part of my construction management course,

has a contract been formed by email? any advice would be greatly appreciated to get me through this .

at 9.00am , on Monday 13th august , Maurice, a mineral speculator, sends an
email to Austin offering to sell him a unique piece of rock for £50,000.
Austin receives the email at 9.15am. and emails his acceptance at 1.00pm.
Austin is aware that Maurice office is closed for lunch between 1.00pm-2.00pm. on his return to the office , Maurice dose not bother to check whether he has received an email from Austin and at 2.30pm receives an offer for the unique rock from ford, which he accepts. at 4.00pm Austin hears from another mineral speculator that Maurice has sold the rock to ford.
he is advised that that it will cost an additional £2000 to buy a similar rock and he immediately sends another Maurice another email demanding that the original rock be sold to him.
Maurice receives this email at 5.00pm at the same time as he reads the acceptance email.

advise Austin of his legal position and what remedies , if any are available to him.
