    Hey all I have an essay for Law, and was just wondering if anybody could input some ideas or suggestions on how to go about answering the question. It is a seen exam question, and therefore I can remember my answer for the exam. The problem is I have never done a seen exam and I am not good at law Thank you in advance. The question is below:



    Robert, a builder, was replacing tiles on the roof of a building he was repairing, assisted by Phil. The pair were rushing to finish the roof before it rained. Robert was throwing the roofing tiles for Phil to catch, rather than passing the tiles from hand to hand, as recommended by the Roof Tilers’ Association.

    Phil failed to catch a tile thrown by Robert and it fell to the ground 8 metres below, striking Patrick, a postman, on the shoulder and causing him injury. Patrick had brittle bones and his injuries were worse than a normal person would have suffered. Patrick was in such pain from his injuries that he stepped into the road where he collided with a passing cyclist, Samuel. Samuel was on his way to work at the local fire station. He fell from his bicycle and was injured.


    Consider what liability in negligence, if any, Robert and Phil have for the injuries sustained by Patrick and Samuel.
