Urgent help: claim I was involved in incident

I received a letter in the post today from my insurers saying I had been involved in an incident, where a third party has supported a claim that I bumped into a vehicle in a Tesco car-park.

Now I am 100% certain that I didn't do this. However, on that same day I did make contact with a bollard next to the trolley storage rack thing. It has left a dent in my car with silver paint and the impression of a cylinder on the car.

I went into tesco and I asked for CCTV footage, but it turns out they only turn the cameras on when they are pursuing somebody (...).

I did, however, witness a staff member watching me as I hit the bollard (low speed). I thought nothing of it ("It's only a bollard, my car will have to be repaired but it's not drastic" etc.) but I'm wondering if she is somehow involved since I don't think anyone else saw me...

Any advice? The insurers rang me today and I spoke to them and an accident specialist is coming around at some point and will hopefully rule in my favor. In the phone call I didn't say I hit the bollard (which I should have!).

Any advice on how to proceed? This whole thing has really pissed me off!

Edit: could someone have seen me hit the bollard and taken it as an opportunity? Could tesco claim against me for damage to the bollard (I doubt it)?

They could, in theory.

To have left a cylinder shaped impression in your car, you must have given it a fair old whack. If you were careless enough to hit a bollard with such force, is it unreasonable to expect you could have hit a car more lightly whilst unaware?

absolutely not; there is only one dent where I hit the bollard. The hit wasn't that strong. I was trying to get into the space approaching from the side of the bollard and as soon as I hit the bollard I reversed back. I 100% did not hit a car

For your insurers to be contacted, someone must have taken down your reg after you have collided with a car/or bollard. Tesco can pursue a claim against you for any damage to bollard. Why do you think they cant?
Have you asked your insurers who is pursuing this claim against you?

I would be contacting Tesco again for CCTV footage or at least get your insurers to request the same.

Either the CCTV cameras are on or they are not. They are not going to be turning them on after an event otherwise it would be pointless.

Bear in mind that the accident specialist wont be making any decisions. He is just there to advise your insurance company. Whoever is pursuing the claim can still pursue it through the courts.

Just seems odd that someone would randomly pick your vehicle.

Tesco could claim against you for damage to the bollard if they wanted to - after all you hit their property. It is unlikely they would (assuming you didn't cause much damage to it - if you knocked it over or put a big dent in it they might).

You need to be completely honest with your insurance company - if they see you have hit something and haven't told them about it, they may decide you are lying to them, and so it is best for them to settle.

The insurance lady said it was a car; I clarified this morning.

The accident specialist came and agreed there was no way a car could have caused the dent. What will happen now? Do I not need to worry?

That's what I would've thought but the staff member categorically said it was only turned on when they were 'pursuing someone.'

Who are you insured with? (I worked in car insurance for two years, there are, of course, different processes.)

- You need to tell your insurance company that you collided with the bollard.
- You also need to tell them that as far as you are aware, you didn't hit any Third Party vehicle. Since there's no footage of you doing it or not doing it, nothing can be proven unless there is either an independent witness who supports the Third Party's version of events, or an independent engineer inspects both your vehicle and the TP vehicle, and determines that their damage isn't consistent with your vehicle.

EDIT: Just saw your later comments. It's likely at this point that your Insurers will attempt to repudiate the claim as a case of mistaken identity, and it'll go away.

If there was damage to the bollard, however, and the staff member notified her superiors, Tesco would be able to claim for the damage from your Insurers (which goes down as a claim on your history).

Well your insurance company will probably tell them that it is a case of mistaken identity and leave the ball in their Court. If they were just trying it on then they probably wont take it any further,

If they want to proceed with the matter further, they will probably instruct solicitors and issue Court proceedings.

Just because a claims investigator agrees with you, doesn't necessarily mean the end of the matter.You would surprised how many people try and claim that they havent been involved in an accident when they have.
