“To require a defendant to prove anything, whether positive or negative, in order to prove that he is not guilty of a crime might, on the face of it, appear to conflict with the presumption of innocence required by Article 6. To interpret Article 6 in this way would, however, conflict in some areas with the requirements of an effective criminal law and the Strasbourg Court has not so interpreted the Article.”

Consider the circumstances in which the accused may be required to prove an element in a criminal case and the impact of the developing Human Rights case law in the application of these principles.

Have a look at Roderick Munday on Evidence. I seem to recall it covering this topic, although it's been a few years since I've studied criminal evidence.
