This is my evidence cw that is in for Dec. I really am stuck in it so was wondering if someone can give me some help on it like relevant stuff i should include or how to go about the structure?

This coursework is designed to assess the following learning outcomes:

1. Appreciate the burden and standard of proof during the course of criminal proceedings.
2. Understand how the accused is protected
3. Consider human rights issues
4. Display critical analysis of the principles

“To require a defendant to prove anything, whether positive or negative, in order to prove that he is not guilty of a crime might, on the face of it, appear to conflict with the presumption of innocence required by Article 6. To interpret Article 6 in this way would, however, conflict in some areas with the requirements of an effective criminal law and the Strasbourg Court has not so interpreted the Article.”

(Lord Phillips CJ in Keogh v R (2007) EWCA Crim528

Consider the circumstances in which the accused may be required to prove an element in a criminal case and the impact of the developing Human Rights case law in the application of these principles.

please please please reply! im so stuck and stressed!!
Have a look at Roderick Munday on Evidence. I seem to recall it covering this topic, although it's been a few years since I've studied criminal evidence.
